Mental Health and Substance Use Disorder Parity

Investigations and enforcements

The Mental Health Parity and Addiction Equity Act (MHPAEA) was signed into law in 2008 to limit financial requirements and treatment limitations on benefits for mental health conditions and substance use disorders as compared to medical/surgical benefits. These protections are vital for America’s workers, health insurance consumers, and their families.

The Employee Benefits Security Administration (EBSA) and the Centers for Medicare & Medicaid Services (CMS) are responsible for enforcing MHPAEA - alongside state governments. To inform the public of EBSA’s and CMS’s enforcements, we’ve summarized our closed investigations and public inquiries related to MHPAEA within a fiscal year.
