ERISA Advisory Opinion on Limited Partnership Health Benefit Programs

This document is the Department of Labor's advisory opinion on whether health benefit programs offered by limited partnerships should be considered employee welfare benefit plans covered under ERISA. The DOL concludes that the limited partners are not employees or bona fide partners of the partnership, and therefore the health benefit programs do not meet the criteria to be ERISA-covered plans.
