ERISA Preemption of Puerto Rico Payroll Deduction Law

This document is about a U.S. Department of Labor advisory opinion on whether ERISA preempts a Puerto Rico law that prohibits employers from making payroll deductions for employee benefit plans. The Department concludes that to the extent the Puerto Rico law is interpreted to prohibit payroll deductions for ERISA-covered plans, it is preempted by ERISA.
