Advisory Opinion 1992-12A

This document is an advisory opinion from the U.S. Department of Labor that the addition of benefits not described in ERISA section 3(1) to those already being provided by an employee welfare benefit plan will not alter the plan's status as an ERISA-covered plan, although the fiduciary standards under ERISA would still apply to the expenditure of plan assets to provide such additional benefits.
