Advisory Opinion 1992-03A

This document is an advisory opinion from the U.S. Department of Labor that the Food Employers Labor Relations Association and Retail Store Employees Union Severance Plan may not qualify as a severance pay plan under the Department's regulation, as the Department is generally not able to provide an opinion on whether a plan that does not fall within the "safe harbor" provided by the regulation would be considered an employee pension benefit plan under ERISA.
