DOL Advisory Opinion 2017-01A on the Health Transformation Alliance

This document is a Department of Labor advisory opinion on whether the Health Transformation Alliance (HTA) program is an employee welfare benefit plan or a multiple employer welfare arrangement (MEWA) under the Employee Retirement Income Security Act (ERISA). The DOL concludes that the HTA program, which provides administrative services to help large employers manage their employee health coverage, is not an employee welfare benefit plan or a MEWA under ERISA because it does not provide benefits to employees and instead facilitates the operation of the employers' own plans.
