IRS Advisory Opinion 2011-05A

This document is about an advisory opinion from the U.S. Department of Labor regarding the use of demutualization proceeds received by the J.B. Hunt Transport Services, Inc. Employee Benefits Plan. The Department concludes that, absent plan terms to the contrary, the plan fiduciaries may use the demutualization proceeds to provide additional benefits to current plan participants, rather than only for the benefit of those participants who contributed to the insurance contracts that generated the proceeds.
