This document is an advisory opinion concluding that under certain conditions, a multinational cross-border pooling arrangement's use of foreign banks, securities depositories and clearing agencies to hold the indicia of ownership of foreign assets would comply with ERISA's requirements for the indicia of ownership of plan assets held outside the U.S.
