Advisory Opinion

This document is about an advisory opinion from the U.S. Department of Labor regarding whether the "health care professional" consulted by a plan's named fiduciary in deciding an appeal of a health claim denial based on a medical judgment must be licensed, accredited, or certified in the same state where the claimant received the services or where the claimant resides. The Department concludes that the regulation does not require licensing in the same state.
