State Employment Security Agencies (SESAs) shall use the attached schedule to determine Federal military wages for UCX "first claims" filed beginning with the first day of the first week which begins after April 3, 1999, pursuant to 20 CFR 614.12. SESAs will continue to use the existing schedule for UCX "first claims" filed before the effective date of the attached revised schedule. As provided by 20 CFR 614.12(d), the attached schedule shall be published as a notice in the Federal Register. Action Required. Administrators should provide the above instructions and the attached revised schedule to appropriate staff.

References: Wagner-Peyser Act, as amended (29 U.S.C. 49); 20 CFR 652 and 20 CFR 653; JTPA Sections 202, 252, 262, 302, and 601, as amended by the Job Training Reform Amendments Act of 1992; Training and Employment Guidance Letters (TEGL) Nos. 4-88, 4-95, Change 1, and 2-97, Change 1. Background: The JTPA Titles II-A and III allotments, and the Wagner-Peyser Act preliminary planning estimates are for the program period July 1, 1999, through June 30, 2000. The Title II-B and II-C allotments are for the period April 1, 1999, through June 30, 2000. These allotments and preliminary planning estimates will be published in the Federal Register. The JTPA allotments and the Wagner-Peyser Act preliminary planning estimates are part of the Fiscal Year 1999 funds appropriated in the Omnibus Consolidated and Emergency Supplemental Appropriations Act of 1998, P.L. 105-277. These appropriations include $995,000,000 for Title II-A, the same as the PY 1998 Title II-A level; $871,000,000 for Title II-B, the same as the FY 1998 Title II-B level; $129,965,000 for Title II-C, the same as the PY 1998 Title II-C level; $1,405,510,000 for Title III, a 4.07 percent increase from PY 1998; and $761,735,000 for allotments to States under the Wagner-Peyser Act, the same as the PY 1998 level. For States which choose to fully or partially implement the Workforce Investment Act (WIA) during Program Year 1999, these allocations will be used to support activities authorized under that legislation with the exception noted below for Titles II-B and II-C. (NOTE: States must continue to operate under JTPA rules until their WIA plans have been approved.) As States implementing WIA during the upcoming program year make strategic decisions on how to approach the delivery of services, it will clearly not be business as usual. For example, the funding provided may call for different contracting decisions than have been the norm under JTPA. In States where Governors choose to wait until July 1, 2000, to implement WIA, these funds will continue to be used in accordance with JTPA rules. Transition guidance will be provided during this quarter. JTPA funds are provided through block grants to the States for employment and training programs. These allotments to States are based on formulas defined in the Act. Under Title II-A (Adult Training Program), States will receive $955 million for job training services for disadvantaged adults and others who face significant employment barriers. For 1999, Title II-B and Title II-C appropriations language allows the funds to be available for obligation on April 1, 1999. This early obligation will allow States to begin making expenditures in advance of the upcoming Summer Youth Employment and Training Program, as well as facilitate the move toward a consolidated youth funding stream. As in previous years, the appropriations bill contains the authority for Service Delivery Areas (SDAs), with approval of the Governor, to transfer up to 100% of the funds between the two youth programs.

To transmit instructions for implementing the revised TAPR in accordance with reporting guidelines required by the enactment of the Trade Adjustment Assistance Extension Act of 2011 (TAAEA) (P.L. 112-40) and the Veterans Opportunity to Work (VOW) to Hire Heroes Act of 2011(P.L. 112-56).  This guidance also updates Training and Employment Guidance Letter (TEGL) No. 6-09, Change 1, issued February 7, 2012, by:

Reference: Veterans Affairs and Housing and Urban Development and Independent Agencies Appropriations Act of 1999, Title II, October 21, 1998, and Federal Register Notice dated January 28, 1999. Background: The VA/HUD and Independent Agencies Appropriations Act of 1999 provides $283 million for the Welfare-to-Work (WtW) Tenant-Based Assistance Program. Under the Act, HUD is authorized to solicit competitive applications from local Public Housing Agencies (PHAs) seeking funds to establish a WtW Rental Voucher program to help eligible families make the transition from welfare to work. The notice requires that all PHAs submitting applications develop their program in consultation with the State, local, or Tribal entity administering the Temporary Assistance for Needy Families (TANF) program and the entity, if any, administering the WtW formula and/or competitive grants administered by the United States Department of Labor. Highlights of the Act: General Information - $283 million (50,000 rental vouchers) is available, until expended, to help eligible families transition from welfare to work. - The initiative will be administered by PHAs, including Indian Tribes and Tribal housing entities. Family Eligibility - Rental vouchers will be available to families who are eligible to receive, currently receive, or have received TANF within the preceding two years. - Administering entity must determine that tenant-based housing assistance is critical to a family=s obtaining or retaining employment. - Families cannot currently be receiving tenant-based rental assistance. Requirements for Competitive Applications - Describe the proposed rental voucher program. - Program developed by PHA in cooperation with TANF and WtW agencies. - Demonstrate that tenant-based housing assistance is critical to families being successful in obtaining or retaining employment. - Specify the criteria to be used in selecting families. - Describe the strategy for tenant counseling, housing search assistance, and landlord outreach. - Request necessary waivers of HUD requirements. - Include certifications from TANF and WtW agencies supporting the proposed voucher program and any necessary coordination and collaboration. - Include any other information required by the Secretary of HUD. The Secretary of HUD, after consultation with the Secretaries of the Departments of Labor and Health and Human Services, shall select PHAs on a competitive basis taking into account: - The need for and quality of the proposed program, including innovative approaches; - The extent to which assistance will be coordinated with welfare reform and WtW initiatives; - The extent to which the application demonstrates that tenant-based assistance is critical to the success of assisting eligible families to obtain or retain employment; and - Other criteria set by the Secretary of HUD. Other provisions include: - One percent of the total ($2.83 million) is available to conduct an evaluation of the effectiveness of the initiative. - Approximately 700 vouchers ($4 million) are also available to support local self-sufficiency and WtW initiatives in each of the following locations: San Bernardino County, CA; Cleveland, OH; Kansas City, MO; Charlotte, NC; Miami/Dade County, FL; Prince George=s County, MD; New York, NY; and Anchorage, AK. Action Required: States should: a. share this information with their WtW and other appropriate staff; and b. cooperate with PHAs that are developing and submitting applications for funding to establish a WtW Rental Voucher program.
