Purpose

To inform states of the guidelines for (a) negotiating PY 2006 performance levels for Wagner-Peyser Act-funded activities under the common measures and (b) re-negotiating Average Earnings targets for the WIA Title IB Adult and Dislocated Worker programs. These negotiated performance goals for PY 2006 will be incorporated in the WIA and Wagner-Peyser Act Two-Year Strategic Plans. This Training and Employment Guidance Letter (TEGL) also clarifies the set of youth measures to which states are accountable for the upcoming program year.

Background: The Employment and Training Administration has awarded a contract to Mathematica Policy Research, Inc. of Princeton, New Jersey to conduct a net impact evaluation of JTPA title III programs for dislocated workers. The objectives of the evaluation are to estimate the net impact of EDWAA services on the post-program employment and earnings of dislocated workers and to estimate the separate impacts of the two major EDWAA services -- basic readjustment services (BRS) and occupational retraining. The evaluation will be based on a random assignment design. It is anticipated that the evaluation will begin this Fall and involve approximately 30 substate grantees and 10,500 EDWAA applicants. The attached "EDWAA Impact Evaluation Design Summary" provides further information on ETA's plans and discusses the major design issues which must be resolved in the next few months. Among the more important issues are: 1. Should activities funded through the National Reserve or the Governor's reserve and rapid response be included in or excluded from the evaluation? 2. Is it possible to measure the net impact of basic readjustment services provided under EDWAA? That is, do EDWAA-funded basic readjustment services differ in quality and/ or quantity from similar services available to dislocated workers from non-EDWAA sources? 3. Where in the EDWAA intake process should random assignment be performed? 4. What factors are likely to affect substate grantees' ability to participate in the evaluation? 5. How should the evaluation treat dislocated workers who are referred to EDWAA as a result of worker profiling or through one-stop career centers? .AT: None

Procedures for Temporary Labor Certification in the Entertainment Industry under the H-2B Visa Program

Purpose

This guidance letter and its attachments replace and supersede prior operating procedures and policy guidance within the Employment and Training Administration (ETA) for H-2B certifications in the entertainment industry, including attachments I - IV of ETA Training and Employment Guidance Letter No. 4-03 (TEGL 4-03). This letter describes the special procedures in ETA governing the H-2B nonimmigrant labor certification process for temporary positions in the entertainment industry. This TEGL, as revised, identifies the Chicago National Processing Center as the Center designated to issue ETA determinations on applications for certification to employ temporary workers in the entertainment industry which are initially filed by employers with designated Offices Specializing in Entertainment (OSEs) within the State Workforce Agencies (SWAs). This is the only substantive change from previous procedures, under which ETA’s New York City, Dallas, and San Francisco Regional Certifying Officers were designated to issue determinations on these applications.

Reference: Older Worker Bulletins: 97-8, "Eligibility Certification for Enrollees in Joint SCSEP-Job Training Partnership Act Programs"; 94-10, "Joint Job Training Partnership Act (JTPA) Senior Community Service Employment Program (SCSEP) Eligibility"; and 94-1, "Technical Amendment to Title V of the Older Americans Act" Background: Although there have been two issuances to the JTPA network regarding joint enrollment in SCSEP and JTPA, many Service Delivery Areas and JTPA Section 204(d) operators remain reluctant to accept eligibility determinations conducted by SCSEP program operators. This situation works to the detriment of seniors who are seeking and in need of employment and training. Recently, Region III issued a Regional Field Memorandum designed to clarify the policy on dual enrollment. This regional issuance reiterates the Department of Labor's policy and briefly discusses some of the concerns that JTPA operators have expressed. A copy of this memorandum is attached for your information. Action: SCSEP sponsors should review the attachment and are encouraged to share copies with appropriate staff and other agencies. We hope this information will foster cooperation between the JTPA and SCSEP programs.
