WASHINGTON — The U.S. Department of Labor will visit Livermore, Calif., to provide information about the Energy Employees Occupational Illness Compensation Program Act (EEOICPA). Through town hall meetings, officials will present details about a new class of former employees of the Lawrence Livermore National Laboratory recently added to the act's Special Exposure Cohort (SEC). Officials also will be on hand to discuss Parts B and E of the EEOICPA and assist individuals with filing claims.

Advanced Professional Marketing Inc. also assessed civil penalty of $512,000

NEW YORK — Advanced Professional Marketing Inc. (APMI), a medical staffing company based in New York City, and the company's president, Marissa Beck, have been charged by the U.S. Department of Labor with violating provisions of the Immigration and Nationality Act that authorize employers to bring non-immigrant workers into the United States under the H-1B program.

Convictions up 20 percent, indictments 39 percent over fiscal year 2007

WASHINGTON — The U.S. Department of Labor today announced that it has paid more than $1 billion to 8,926 individuals under Part E of the Energy Employees Occupational Illness Compensation Program Act (EEOICPA). Part E of the act was created as an amendment to the EEOICPA in October 2004 to alleviate the delay claimants were experiencing under the old Part D program administered by the U.S. Department of Energy. The Labor Department was charged with implementation of Part E.

WASHINGTON —In January 2008, the U.S. Department of Labor's Office of Labor-Management Standards (OLMS) marked its 5,000th indictment since recordkeeping began in 1964. During January, OLMS obtained eight convictions, nine indictments and court orders of restitution totaling $121,867. The office's totals for fiscal year 2008 (which began on Oct. 1, 2007), including previously unreported indictments and convictions from prior months, now stand at 36 convictions, 47 indictments and court-ordered restitution of $877,212.

WASHINGTON — The U.S. Department of Labor will publish a proposal on Feb. 11 to update its regulations under the 15-year-old Family and Medical Leave Act (FMLA) — a measure that will help workers and their employers better understand their rights and responsibilities, and speed the implementation of a new law that expands FMLA coverage for certain military family members.

WASHINGTON — The U.S. Department of Labor has announced that Alexander J. Passantino will serve as the acting administrator of the department's Wage and Hour Division. Passantino was named deputy administrator for the division in October 2006. He first joined the U.S. Department of Labor in November 2005 as a senior policy advisor to the assistant secretary for the Employment Standards Administration.

WASHINGTON — The U.S. Department of Labor's Office of Labor-Management Standards (OLMS) today announced its criminal enforcement data for Fiscal Year (FY) 2007, highlighting increases over previous years. Court-ordered restitution of union funds has risen in each year since FY 2001, with only one exception. In FY 2001, the amount was just under $2 million and in FY 2007, the amount was over $32 million. Criminal case processing is up 10 percent over FY 2001 (406 from 370), while convictions are up 16 percent (118 from 102).

WOONSOCKET, R.I. — Woonsocket-based CVS Pharmacy Inc. has agreed to pay the U.S. Department of Labor civil money penalties totaling $226,598 and to pay 51 employees back wages totaling $38,151 following an investigation by the department that revealed violations of the wage and youth employment provisions of the federal Fair Labor Standards Act (FLSA).

OLMS obtained 16 indictments and five convictions during the first month of fiscal year 2008, and court-ordered restitution in October amounted to $63,499. These indictments and convictions primarily involve union officers and employees who have embezzled union funds.

HOUSTON — Allied Home Mortgage Corp. in Houston has paid $1,855,518 in back wages after an investigation by the U.S. Department of Labor's Wage and Hour Division found 588 branch managers, loan officers, loan processors and clerks, who were performing inside sales work at the company, had not been properly paid.

WASHINGTON — U.S. Secretary of Labor Elaine L. Chao today extended the term of the Office of the Ombudsman for the Energy Employees Occupational Illness Compensation Program until Congress passes legislation to make the office permanent.

The Defense Authorization Act of 2005 created the Office of the Ombudsman for a three-year period to provide information on the benefits available under Part E of the Energy Employees Occupational Illness Compensation Program Act (EEOICPA) program, and the office was set to expire on October 28, 2007.
