Statement of Reasons
For Dismissing the Complaint
Concerning the Trusteeship
Imposed on Local 597 of the International Association
of Bridge, Structural, Ornamental & Reinforcing Iron Workers
in Jacksonville, Florida

A member in good standing of the International Association of Bridge, Structural, Ornamental & Reinforcing Iron Workers, Local 597, filed a complaint with the Secretary of Labor alleging that the International union improperly imposed a trusteeship on Local 597. Specifically, the complaint alleged that the trusteeship was imposed for an impermissible purpose and in a manner inconsistent with Title III of the Labor-Management Reporting and Disclosure Act of 1959 (Act), 29 U.S.C. §§461-466, et seq.

The Department’s investigation disclosed that on July 7, 2009, the International’s General President informed the officers of Local 597 that they had been divested of their officer positions. The investigation further revealed that on September 11, 2010, an election of officers was held, and new officers were installed. Following the installation of officers, the trusteeship was terminated on October 5, 2010. Thus, full autonomy was restored to Local 597.

For the reasons stated above, any questions whether proper procedures were followed and whether the trusteeship was valid are moot. Accordingly, this matter does not require any further action on the part of the Department of Labor and we are closing our file on this matter.

This is to advise you of the disposition of a complaint filed with the Secretary of Labor alleging that violations of Title III of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA), occurred with respect to the trusteeship imposed by International Association of Bridge, Structural, Ornamental, and Reinforcing Iron Workers over Iron Workers Local 597 in Jacksonville, Florida.

Pursuant to Sections 304 and 601 of the LMRDA, an investigation was conducted by the Office of Labor-Management Standards. After carefully reviewing the investigative findings, and after consulting with the Solicitor of Labor, we have determined that legal action is not warranted in this case. We are, therefore, closing our file as of this date.

The basis for this decision is set forth in the enclosed Statement of Reasons.
