Below is a list of voluntary compliance agreements entered into in 2023.


On November 30, 2023, OLMS entered into a voluntary compliance agreement with American Federation of Government Employees (AFGE) Second District NYNJ Veterans Affairs Council (Council 246), located in St. Albans, N.Y., concerning a May 5, 2023 election of union officers. The union agreed to hold a new election for the offices of president, first vice president, and treasurer. The investigation found that the union allowed delegates from locals in arrears on per capita dues payments to nominate and vote in the election. The agreement follows an investigation by the OLMS New York District Office.

On November 20, 2023, OLMS entered into a voluntary compliance agreement with American Federation of Government Employees (AFGE) District 4 (located in Washington, D.C.), concerning the union’s May 20, 2023 national officer election. The union agreed to conduct a new caucus election, including credentialing of all delegates, for the office of District 4 National Vice President, under OLMS supervision. The investigation found that AFGE District 4 denied members the right to vote when some local unions did not receive the proper number of ballots to vote in the District 4 national officer election. The agreement follows an investigation by the OLMS Washington District Office.

On November 16, 2023, the Department entered into a voluntary compliance agreement with National Association of Broadcast Employees and Technicians – Communications Workers of America (NABET-CWA) Local 41, also known as CWA Local 54041 (located in in Chicago, Ill.). The union agreed to conduct new nominations, election, and installation for all officers, stewards, and alternate stewards to bring Local 41 out of trusteeship under OLMS supervision no later than March 30, 2024. The investigation concluded the local union failed to provide proper notice of nominations for their steward/alternate steward election in violation of their constitution and bylaws as well as Section 401(e) of the LMRDA. The agreement follows an investigation by the OLMS Chicago and Dallas-New Orleans District Offices.

On November 6, 2023, OLMS entered into a voluntary compliance agreement with the American Federation of Government Employees (AFGE), Veterans Affairs, Eighth District, Leadership Council 259 (located in Swisher, Iowa), concerning a union officer election conducted on May 20, 2023. The OLMS investigation concluded that the delegates from Local 3669 were not eligible to be seated at the Council 259 caucus election. The union agreed to conduct a new caucus election, including credentialing of all delegates, to include the supervision of new nominations and election for any delegates not properly elected. AFGE Leadership Council 259 agreed that the new caucus election will include new nominations and a new election for the delegates voting on behalf of AFGE Local 3669. The union agreed to complete the caucus election before May 15, 2024. The agreement follows an investigation by the OLMS Detroit-Milwaukee District Office.

On October 31, 2023, OLMS entered into a voluntary compliance agreement with American Federation of Government Employees (AFGE) Local 2453 (located in Jacksonville, Fla.). The investigation found that Local 2453 has not held an officer election since at least 2018, in violation of Section 401(b) of the LMRDA. The union agreed to conduct new nominations, a new election, and installation for the offices of President, Vice-President, Second Vice-President, Secretary-Treasurer, Chief Steward, and Sergeant at Arms. The union agreed that the election will be conducted before February 23, 2024, under OLMS supervision. The agreement follows an investigation by the OLMS Atlanta-Nashville District Office.

On October 28, 2023, OLMS entered into a voluntary compliance agreement with International Association of Machinists & Aerospace Workers (IAM) District Lodge 19 (located in Denver, Colo.), concerning the June 9, 2023, officer election. The union agreed to conduct a new election, with new nominations, if necessary, for the offices of president/directing general chairman and secretary/treasurer, under OLMS supervision. The investigation concluded that District Lodge 19 failed to re-mail election notices, even though forwarding addresses were provided by the U.S. Postal Service for more than 104 members. The agreement follows an investigation by the OLMS Denver-St. Louis District Office.

On October 27, 2023, OLMS entered into a voluntary compliance agreement with Roofers Local 74 (located in West Seneca, N.Y.), concerning the September 13, 2023, officer election. The union agreed to conduct new nominations, a new election, and installation for the offices of business manager, business agent, president, vice president, recording-secretary, sergeant at arms, and four executive board members, under OLMS supervision. The investigation concluded that the union failed to comply with LMRDA Section 401(e) when it denied members in good standing the right to be candidates when it imposed an unreasonable membership meeting attendance requirement rendering approximately 94 percent of the membership ineligible to seek union office. The agreement follows an investigation by the OLMS Boston-Buffalo District Office.

On September 26, 2023, OLMS entered into a voluntary compliance agreement with International Brotherhood of Electrical Workers (IBEW) Local 53 (located in Kansas City, Mo.) concerning the June 21, 2023 officer election. The union agreed to conduct a new election and installation for the offices of business manager/financial secretary, and five executive board positions before January 31, 2024. The investigation concluded that the union failed to provide adequate safeguards when it provided unclear voting instructions in the ballot packages mailed to members, in violation of Section 401(c) of the LMRDA. The agreement follows an investigation by the OLMS Denver-St. Louis District Office.

On September 14, 2023, OLMS entered into a voluntary compliance agreement with American Postal Workers Union (APWU) Local 130 (located in Indianapolis, Ind.), concerning the union’s March 23, 2023 officer election. Local 130 agreed to hold new nominations, if necessary, and a new election for the offices of clerk craft director A, clerk craft director D, and trustee (three positions). The investigation revealed that Local 130 candidates used contact information obtained through their jobs at the United States Postal Service and their union positions to send campaign text messages to members using an outside company. The agreement follows an investigation by the OLMS Cincinnati-Cleveland District Office.

On June 15, 2023, OLMS entered into a voluntary compliance agreement with the Farm Labor Organizing Committee (FLOC), located in Toledo, Ohio, concerning the union’s September 10, 2022, election of officers. FLOC agreed to hold new nominations and a new election for the offices of president, vice president, secretary-treasurer, and general executive board. The investigation concluded FLOC failed to provide its members with a reasonable opportunity to vote. The investigation also determined that the location of the polls and the length of the time for voting were unreasonable for members who did not live or work close by. The union held its election in Toledo, Ohio without ensuring that all its members, most of whom work in North Carolina, would be able to take off from work to travel to Toledo to vote. The agreement follows an investigation by the OLMS Cincinnati-Cleveland District Office.

On June 5, 2023, OLMS entered into a voluntary compliance agreement with the National Fraternal Order of Police (NFOP) Pentagon Police Labor Committee (PPLC), located in Arlington, Va., concerning the union’s failure to hold an election of officers. The investigation concluded that the PPLC had not held an election in more than three years, in violation of 29 U.S.C. 401(b) of the LMRDA. The agreement follows an investigation by the OLMS Washington District Office.

On April 14, 2023, OLMS entered into a voluntary compliance agreement with American Federation of Government Employees (AFGE) Local 1250 (located in Phoenix, Ariz.), concerning a union officer election conducted in December 2022. Local 1250 agreed to conduct new nominations and an election for their officer positions under OLMS supervision. The investigation determined that the union failed to provide a reasonable opportunity to nominate and failed to follow its own constitution and bylaws during its election. The investigation also found that the local sent the nomination notice with fewer than 10 days for members to submit their nominations and acceptances to the P.O. Box before the deadline. Additionally, the union refused to accept in-person or hand-delivered nominations and acceptances. The agreement follows an investigation by the OLMS Los Angeles District Office.

On March 27, 2023, OLMS entered into a voluntary compliance agreement with Graphic Communications Conference (GCC) – International Brotherhood of Teamsters (IBT) Local 406-C (located in Farmingdale, N.Y.). The union agreed to conduct a new election and installation for the office of president before September 22, 2023, under OLMS supervision. The investigation concluded that the local failed to mail an election notice to all members at their last known home address not less than 15 days prior to the election, in violation of Section 401(e) of the LMRDA. The agreement follows an investigation by the OLMS New York District Office.

On February 15, 2023, OLMS entered into a voluntary compliance agreement with United Auto Workers (UAW) Local 7777 (located in Detroit, Mich.), concerning a union officer election conducted on June 21, 2022. UAW Local 7777 agreed to conduct a new election for the office of trustee (three positions) under OLMS supervision on or before June 30, 2023. The investigation concluded that the union failed to mail an election notice to at least 16 members, denied members the right to vote (when the polling hours conflicted with a work shift), and failed to provide adequate safeguards to ensure a fair election when ineligible members voted. The agreement follows an investigation by the OLMS Detroit-Milwaukee District Office.

On January 30, 2023, OLMS entered into a voluntary compliance agreement with the Special Deputy Marshals of America (SDMOA), located in Washington, D.C., concerning a union officer election on August 20, 2022. SDMOA agreed to install the winning candidate for president. The investigation concluded that the union by failed to install the winning candidate for president into office as required by the SDMOA Constitution & Bylaws. The union’s failure to install the officer also resulted in the former president holding office for more than three years, in violation of 29 U.S.C. 401(b) of the LMRDA. The agreement follows an investigation by the OLMS Washington District Office.
