Below is a list of voluntary compliance agreements entered into in 2022.
On December 7, 2022, American Federation of Government Employees (AFGE) Local 2778 (located in Decatur, Ga.) entered into a voluntary compliance agreement with OLMS concerning the union’s May 2022 primary election and June 2022 runoff election. The union agreed to conduct a new election for the offices of president, vice president, secretary, treasurer, and chief steward on or before May 5, 2023, under OLMS supervision. The investigation disclosed that the union denied members the right to vote when it failed to take reasonable steps to maintain current mailing addresses for its members and to distribute election ballots to all members who were eligible to vote. The investigation further found that the union failed to comply with reasonable requests from candidates to distribute campaign literature by email to members at their own expense. The agreement follows an investigation by the OLMS Atlanta-Nashville District Office.
On November 7, 2022, OLMS entered into a voluntary compliance agreement with the International Alliance of Theatrical Stage Employees (IATSE) Local 44 (located in Valley Village, Calif.), concerning its March 31, 2022, election of officers. The union agreed to conduct a runoff election for the offices of two propmaker representative positions, one property representative position, and one construction coordinator representative position on or before January 31, 2023, under OLMS supervision. The investigation found that the union failed to follow its constitution and bylaws when it did not enforce a majority vote requirement. The agreement follows an investigation by the OLMS Los Angeles District Office.
On November 4, 2022, the Department entered into a voluntary compliance agreement with Steelworkers Local 7600 (located in Fontana, Calif.). The union agreed to conduct new nominations, election, and installation for the office of president before February 2, 2023, under OLMS supervision. The investigation concluded that the local union denied the complainant, a member in good standing, the opportunity to be a candidate in the April 19, 2018, election of officers in violation of Sections 401(c) and (e) of the LMRDA. The agreement follows an investigation by the OLMS Los Angeles District Office.
On October 14, 2022, OLMS entered into a voluntary compliance agreement with American Federation of Government Employees (AFGE) 7th Veteran’s Affairs (VA) District Council 59 (located in Carrollton, Mich.) to conduct a new election and installation for the office of district representative on or before February 17, 2023, under the supervision of the Secretary of Labor. The OLMS investigation established that the union allowed an ineligible delegate to cast a ballot in the district representative race, in violation of Section 401(e) of the LMRDA. The agreement follows an investigation conducted by the OLMS Detroit-Milwaukee District Office.
On September 26, 2022, the Department entered into a voluntary compliance agreement with National Treasury Employees Union (NTEU) Chapter 282 (located in Silver Spring, Md.). The union agreed to conduct nominations, election, and installation for all chapter officer positions including, but not limited to, president, executive vice president, secretary, treasurer, chief steward (if applicable), CBER vice president, DCER vice presidents, CDRH vice president, CFSAN vice president, CVM vice president, OC vice president, ORA/BTL district vice president, and CTP vice president. The union agreed to complete the election before December 31, 2022. The OLMS investigation revealed that the union failed to hold an election in more than three years, in violation of Section 401(b) of the Labor-Management Reporting and Disclosure Act of 1959. The agreement follows an investigation by the OLMS Washington District Office.
On June 8, 2022, OLMS entered into a voluntary compliance agreement with Industrial Workers of the World – North American Regional Administration (IWW NARA), located in Chicago, Ill., concerning its November 30, 2021, election of officers. The union agreed to conduct new nominations and a new election for the offices of general secretary-treasurer and seven seats on the general executive board under OLMS supervision on or before December 1, 2022. The investigation disclosed that the union failed to permit members in good standing the right to be candidates when it failed to provide those members due process at the hearing during the disciplinary process, which led to several nominated members being barred from running for office, despite pending appeals. The agreement follows an investigation by the OLMS Chicago District Office.
On May 6, 2022, OLMS entered into a voluntary compliance agreement with Transport Workers Union (TWU) Local 241 (located in New York, N.Y.) to conduct a new election and installation for the offices of vice president, treasurer, three at-large executive board members, one Juilliard executive board member, and one public safety board executive board member to be completed on or before September 15, 2022, under the supervision of the Secretary of Labor. The investigation established that the union failed to mail a notice of election to all members at their last known home address not less than 15 days prior to the election, in violation of Section 401(e) of the LMRDA. The investigation further found that the union failed to properly secure unused ballots prior to the election, in violation of Section 401(c) of the LMRDA. The agreement follows an investigation conducted by the OLMS New York District Office.
On April 28, 2022, the Department entered into a voluntary compliance agreement with American Postal Workers Union (APWU) Local 1291 (located in Petaluma, Calif.). The union agreed to conduct new nominations, and a new election and installation, for the offices of president, vice president, and secretary-treasurer under OLMS supervision before August 30, 2022. The investigation concluded that Local 1291 denied a member in good standing the opportunity to nominate and be nominated, in violation of Section 401(e) of the LMRDA. The agreement follows an investigation by the OLMS San Francisco-Seattle District Office.
On March 30, 2022, OLMS entered into a voluntary compliance agreement with Teamsters Local 385 (located in Orlando, Fla.). The union agreed to conduct a new election (and new nominations, if necessary) for the office of third trustee before June 30, 2022. The investigation concluded that Local 385 funds were used to promote the candidacy of certain candidates in that union vehicles were used for campaigning, in violation of Section 401(g) of the LMRDA. The agreement follows an investigation by the OLMS Atlanta-Nashville District Office.
