2009

On December 23, 2009, OLMS entered into a voluntary compliance agreement with the Waltham Drivers Association (located in Waltham, Mass.) concerning the election of officers conducted on October 14, 2009.  The OLMS investigation of the challenged election found that the Waltham Drivers Association failed to provide adequate safeguards to ensure a fair election, failed to protect ballot secrecy and denied a member his right to vote.  The union agreed to conduct a new election, under OLMS supervision, for President and Vice President.  The agreement follows an investigation by the OLMS Boston District Office.

On November 20, 2009, OLMS entered into a voluntary compliance agreement with Carpenters Local 1644 (located in Minneapolis, Minn), concerning a challenged election conducted by Local 1644 on June 3, 2009.  The union agreed to conduct a new election for financial secretary under OLMS supervision.  The OLMS investigation of the challenged election found that Local 1644 allowed ineligible members to vote and union funds were used to promote the candidacy of certain candidates.  The agreement follows an investigation by the OLMS Minneapolis Resident Investigator Office.

On November 20, 2009, OLMS entered into a voluntary compliance agreement with the American Federation of Teachers (AFT), concerning a trusteeship over AFT Local 4524, Federation of Indian Service Employees (FISE) (located in Albuquerque, N.M.).  The union agreed to conduct nominations, an election, and the installation of officers for all AFT Local 4524 offices under OLMS supervision in order to bring Local 4524 out of trusteeship.  The OLMS investigation of the trusteeship found that the AFT imposed the trusteeship for a valid reason in accordance with the Civil Service Reform Act of 1978 (CSRA), however, the 18-month presumption of validity expired and the continuation of the trusteeship was not valid for a purpose allowable under the CSRA.  The agreement follows an investigation by the OLMS Denver District Office. 

On November 4, 2009, OLMS entered into a voluntary compliance agreement with the New York State United Teachers (NYSUT) (located in Latham, New York), concerning the challenged election of retiree delegates to the National Education Association (NEA) Representative Assembly conducted by NUSUT on March 9, 2009.  The union agreed to conduct a new election for three retiree delegates under OLMS supervision.  The OLMS investigation of the challenged election found that NYSUT failed to mail ballots to all eligible members at their last known home address, made no effort to re-mail ballot packages returned undelivered and failed to preserve returned undeliverable ballot envelopes for at least one year.  The agreement follows an investigation by the OLMS Buffalo District Office. 

On November 2, 2009, OLMS entered into a voluntary compliance agreement with Communications Workers of America Local 13301 (located in Ridley Park, Pa.), concerning the challenged election of officers held in November and December 2008. Local 13301 agreed to conduct new nominations and elections, under OLMS supervision, for the offices of President, Executive Vice President, Secretary, and Philadelphia Airport Vice President. The OLMS investigation of the challenged election found that the local failed to maintain an accurate membership list, failed to mail nomination and election notices to all members, allowed ineligible members to vote and did not count the vote of an eligible member. The voluntary compliance agreement follows and investigation by the OLMS Philadelphia District Office.

On September 21, 2009, the OLMS entered into a voluntary compliance agreement with the Industrial Professional and Technical Workers Union (IPTWU), IPTWU Local 1, and IPTWU Local 2 (all located in Downey, Calif.), concerning the alleged failure of the unions to hold regularly scheduled elections of officers. To remedy their failure to hold elections, IPTWU, IPTWU Local 1, and IPTWU Local 2 agreed to conduct nominations and elections, under OLMS supervision. The IPTWU election will include the offices of president, secretary-treasurer, and three executive board members. The elections in Local 1 and Local 2 will include the offices of president, secretary, treasurer, convention delegates, and alternate convention delegates. The agreement follows an investigation by the OLMS Los Angeles District Office.

On September 17, 2009, OLMS entered into a voluntary compliance agreement with IBEW Local 363 (located in Harriman, N.Y.) concerning a challenged election of officers conducted June 23, 2009. The union agreed to conduct new nominations, a new election, and installation for executive board members and delegates and alternates to the international convention, under OLMS supervision. The OLMS investigation disclosed that the local did not uniformly apply a candidacy requirement from its international constitution that prohibits members who hold management positions from being a candidate. The agreement follows an investigation by the OLMS New York District Office.

On September 12, 2009, OLMS entered into a voluntary compliance agreement with American Federation of State, Municipal and County Employees (AFSCME) Local 2568 (located in Lincoln Park, Mich.) concerning the election of officers conducted on April 2, 2009. The OLMS investigation concluded that the AFSCME Local 2568 failed to provide all members a reasonable opportunity to vote. The union agreed to conduct a runoff election or, if necessary a new election, under OLMS supervision for the position of president. The agreement follows an investigation by the OLMS Detroit District Office.

On September 10, 2009, OLMS entered into a voluntary compliance agreement with the International Brotherhood of Teamsters (IBT) Local 948 (located in Visalia, California) concerning the election of officers that concluded on December 30, 2008. The OLMS investigation concluded that the election was not conducted with sufficient safeguards to ensure a fair election in that eligible members gave their blank ballots to other persons to vote instead of voting the ballots themselves. The union agreed to conduct a new election, including nominations, under OLMS supervision. OLMS and IBT Local 948 further agreed that the remedial election would be for a three-year term of office. The agreement follows an investigation by the OLMS San Francisco District Office.

On September 3, 2009, OLMS entered into a voluntary compliance agreement with the International Longshoremen’s Association Local Union 2038 (located in Portage, Ind.), concerning a challenged election of officers conducted on March 12, 2009. The union agreed to conduct new nominations and a new election, under OLMS supervision, for the offices of president, secretary-treasurer and business agent. The OLMS investigation of the challenged election found that Local 2038 failed to permit all members in good standing the right to vote; failed to provide proper notice of nominations to all members; and, failed to provide a reasonable opportunity to nominate. The agreement follows an investigation by the OLMS Chicago District Office.
 

On July 22, 2009, OLMS entered into a voluntary compliance agreement with Association of Professional Flight Attendants (APFA) (located in Euless, Texas), concerning the election of officers conducted on February 26, 2009.  The OLMS investigation concluded that the union failed to count two ballots returned by eligible members, allowed one ineligible member to vote, and failed to maintain accurate and consistent election records.  The union agreed to conduct new nominations, if necessary, and a new election, under OLMS supervision, for the St. Louis Base Vice-Chairperson position, a race where the margin was three votes.  The agreement follows an investigation by the OLMS Dallas District Office.

On June 9, 2009, OLMS entered into a voluntary compliance agreement with the Professional Security Employees Association (PSEA) Local 1 (located in Schenectady, N.Y.) concerning the election of officers conducted on December 11, 2008.  The OLMS investigation concluded that candidates were placed on slates on the ballot without their knowledge and/or consent.  In addition, members were only permitted to vote for an entire slate and were denied the right to vote for individual candidates. Advised of these findings, the union agreed to conduct new nominations and a new election, under OLMS supervision, for all officer positions.  The agreement follows an investigation by the OLMS Buffalo District Office. 

On April 2, 2009, OLMS entered into a voluntary compliance agreement with Communications Workers of America (CWA) Local 6215 (located in Dallas, Texas), concerning the election of officers conducted on October 10, 2008. The local agreed to conduct a new election, under OLMS supervision, for the positions of President, Executive Vice-President, Treasurer, and Chief Stewards in jurisdictions 1, 6, 8, 14, 15, and 19. The OLMS investigation of the challenged election concluded that at least 191 votes were not counted when the union mailed an election notice with two possible deadlines for returning completed ballot packages; 199 ballot packages returned undeliverable were not re-mailed; four members were not mailed ballots due to a computer code error; the union failed to provide adequate safeguards in the preparation of the ballots; and observers were not allowed to observe the entire ballot tally. The agreement follows an investigation by the OLMS Dallas District Office. 

On March 31, 2009, the Department entered into a voluntary compliance agreement with the United Association of Journeymen and Apprentices of the Plumbing and Pipe Fitting Industry (UA), concerning a trusteeship imposed over UA Local 211 (located in Houston, Texas) in May 2007.The UA agreed to conduct an election of officers for Local 211 and lift its trusteeship after the installation of officers on or before August 31, 2009.The UA failed to prove by clear and convincing evidence that the continuation of the trusteeship beyond its initial eighteen-month period was necessary for a purpose allowable under Section 302 of the LMRDA. The voluntary compliance agreement follows an investigation by the OLMS New Orleans District Office.

On March 13, 2009, OLMS entered into a voluntary agreement with International Longshore and Warehouse Union (ILWU) Local 13 (located in Long Beach, Calif.) concerning the election of caucus delegates conducted September 23 – 25, 2008. The union agreed to conduct new nominations and a new election, under OLMS supervision, for ten caucus delegate positions. The OLMS investigation concluded that the union imposed an unreasonable candidacy requirement, which required that a member must have worked in the longshore industry within the local for a minimum of five years prior to the election. The agreement follows an investigation by the Los Angeles District Office.

On February 13, 2009, OLMS entered into a voluntary compliance agreement with Southwest Airlines Pilots' Association (SWAPA) (located in Dallas, Texas) concerning a challenged election of officers conducted on October 24, 2008. According to OLMS' investigative findings, certain union officials used union laptops and union time to campaign. Advised of these findings, the union agreed to conduct a runoff election for the 2nd Vice President position under OLMS supervision. The agreement follows an investigation by the OLMS Dallas District Office.

On February 2, 2009, OLMS entered into a voluntary compliance agreement with International Brotherhood of Electrical Workers (IBEW) Local 212 (located in Cincinnati, Ohio) concerning the election of officers conducted on June 2, 2008. The union agreed to conduct a new election under OLMS supervision for the offices of Business Manager and the sixth Executive Board position. The OLMS investigation of the challenged election concluded that the union failed to provide adequate safeguards to ensure a fair election when it tallied absentee ballots returned without the information necessary to confirm the voters' eligibility; denied eligible members the right to vote; and failed to properly notify members of the election when it made no attempt to update the contact information for members listed in the union records without an address. The agreement follows an investigation by the OLMS Cincinnati District Office.

On January 15, 2009, the Department entered into a voluntary compliance agreement with the American Federation of State, Council and Municipal Employees (AFSCME) District Council 33 (located in Philadelphia, Pa.) concerning an election of officers conducted on May 13, 2008. District Council 33 agreed to conduct a new election under, OLMS supervision, for President, Vice-President and Secretary-Treasurer. The OLMS investigation concluded that union funds were used to create and distribute campaign literature and a video presentation, the union logo was used on campaign literature, and campaign literature was sent using the City of Philadelphia's email system. The voluntary compliance agreement follows an investigation by the OLMS Philadelphia District Office.

 

2008


On November 14, 2008, OLMS entered into a voluntary compliance agreement with Dean Transportation Employees Union (DTEU) (located in Lansing, Mich.) concerning the challenged election of officers conducted on August 19, 2008.  The union agreed to conduct new nominations, if necessary, and a new election, under OLMS supervision, for the offices of President, Vice President, Secretary, Treasurer, and Chief Steward. The OLMS investigation of the challenged election disclosed that DTEU failed to elect officers by secret ballot. The union numbered the ballots and kept records of the ballot used by each voter.  The agreement follows an investigation by the OLMS Detroit District Office. 

On October 8, 2008, OLMS entered into a voluntary compliance agreement with United Auto Workers (UAW) Local 400 (located in Utica, Mich.) concerning a challenged election of local officers conducted on April 16, 2008. The union agreed to conduct a new election, under OLMS supervision, for the positions of President and Vice- President. The OLMS investigation of the challenged election disclosed that candidates were denied the opportunity to mail their campaign literature to a portion of the membership. The agreement follows an investigation by the OLMS Detroit District Office.

On September 22, 2008, OLMS entered into a voluntary compliance agreement with the Service Employees International Union (SEIU) Local 24/7 (located in San Francisco, Calif.) concerning a challenged election of local officers conducted on May 14, 2008. The union agreed to conduct a new election, under OLMS supervision, for the positions of President, Vice President, Secretary-Treasurer and five Executive Board positions representing San Francisco, East Bay, North Bay, Northern California, and retired members. The OLMS investigation of the challenged election disclosed that, because of inaccuracies in the local’s mailing list, the local failed to mail nomination and election notices to all members; the local failed to conduct an election by secret ballot when the names of over 100 members could be linked to their ballot; denied a member the right to run for office despite the member having met the local’s eligibility requirements; failed to mail ballots to a portion of the union’s membership; and a local union employee used her union e-mail account to arrange a campaign mailing for the incumbent slate.   The agreement follows an investigation by the OLMS San Francisco District Office. 

On September 18, 2008, OLMS entered into a voluntary compliance agreement with Steelworkers Local 272 (located in Bastrop, La.),concerning a challenged election of officers conducted on May 1, 2006. The union agreed to conduct, under OLMS supervision, the election for the offices of President, Vice-President, Recording Secretary, Financial Secretary, Treasurer, Guide, Guard (2), and Trustee (3).  The OLMS investigation of the challenged election disclosed that the union failed to elect by secret ballot and failed to provide adequate safeguards by allowing candidates to handle and count the ballots. The agreement follows an investigation by the OLMS New Orleans District Office.

On September 15, 2008, OLMS entered into a voluntary compliance agreement with Local 103 of the International Brotherhood of Electrical Workers (IBEW) (located in Dorchester, Mass.), concerning a challenged election of officers conducted on May 3, 2008. The union agreed to conduct, under OLMS supervision, a new election and installation for the office of Business Manager. The OLMS investigation of the challenged election disclosed use of employer funds to promote a candidate, use of union time and equipment to promote a candidate, and ineligible contractor members being permitted to vote in violation of the union’s constitution and bylaws.  The agreement follows an investigation by the OLMS Boston District Office.

On September 7, 2008, OLMS entered into a voluntary compliance agreement with the Communications Workers of America (CWA) concerning CWA Local 2101 (located in Baltimore, Md.).  The union agreed to conduct, under OLMS supervision, nominations, election, and the installation of all officers for Local 2101, and to terminate the trusteeship over the local upon installation of the newly elected officers. The OLMS investigation of the challenged trusteeship disclosed that a hearing was not held within a reasonable time after the trusteeship was imposed and that the trusteeship continued beyond 18 months without clear and convincing proof that the continuation was necessary for an allowable purpose.  The agreement follows an investigation by the OLMS Washington District office. 

On August 18, 2008, OLMS entered into a voluntary compliance agreement with Bakery Workers Local 253 (located in Cincinnati, Ohio), concerning a challenged election of officers conducted during November 16-17, 2007.  The union agreed to conduct, under OLMS supervision, new nominations and an election for the position of Sergeant at Arms.  The OLMS investigation of the challenged election revealed that an ineligible candidate ran for sergeant at arms. The agreement follows an investigation by the OLMS Cincinnati District Office.

On August 14, 2008, OLMS entered into a voluntary compliance agreement with the International Union of Operation Engineers (IUOE) Local 520 (located in Granite City, Ill.), concerning the election of officers conducted on August 10, 2007. The union agreed to conduct, under OLMS supervision, a new election for the positions of Business Manager, President, Vice President, Recording-Corresponding Secretary, Treasurer and Financial Secretary.  The OLMS investigation of the challenged election disclosed that union funds were used in the preparation of campaign literature. The agreement follows an investigation by the OLMS St. Louis District Office. 

On August 1, 2008, OLMS entered into a voluntary compliance agreement with the Service Employees International Union (SEIU) Local 1107 (located in Las Vegas, Nev.), concerning the challenged election of officers conducted on September 4 and 5, 2007.  The union agreed to conduct, under OLMS supervision, a new election for the positions of President, Executive Vice President, Secretary, Trustee (3 positions), Vice President for the City of Las Vegas Housing Authority, Chief Steward for the City of Las Vegas Housing Authority, Nursing Chief Steward for St. Rose San Martin, and Vice President for Sunrise Hospital.  The OLMS investigation disclosed that all candidates were not given equal access to union steward lists which some candidates used to make campaign phone calls, employer resources were used to collect contributions that were donated to a slate’s campaign fund, and employer funds were used in preparing and mailing campaign literature.  The agreement follows an investigation by the OLMS San Francisco District Office.

On July 30, 2008, OLMS entered into a voluntary compliance agreement with the American Federation of Government Employees (AFGE) Local 1738 (located in Salisbury, N.C.), concerning a challenged election of officers conducted on December 11, 2007.  The union agreed to conduct, under OLMS supervision, a new election for the position of Sergeant at Arms.  The OLMS investigation disclosed that some members who requested duplicate ballots were not sent duplicate ballots and individuals who joined the union after the ballots were mailed to the membership on November 7, 2008 were not sent ballots even though they were entitled to vote.  Additionally, the union failed to maintain certain election records.  The agreement follows an investigation by the OLMS Nashville District Office. 

On July 22, 2008, OLMS entered into a voluntary compliance agreement with the American Federation of Government Employees (AFGE) National Union and AFGE Local 2400 (located in Nashville, Tenn.), concerning Local 2400’s challenged election of officers conducted on December 6, 2007.  The unions agreed to conduct, under OLMS supervision, new nominations and a new election for all contested positions.  The OLMS investigation revealed that the local failed to elect officers by secret ballot, in that the room was too small to accommodate any type of privacy, which caused members voted on top of the ballot box located in front of the election committee and on the table top where the committee was seated. The agreement follows an investigation by the OLMS Nashville District Office.

On July 15, 2008, OLMS entered into a voluntary compliance agreement with Postal Mail Handlers Local 301 (located in Natick, Mass.) concerning a challenged election held on December 4, 2007.  The union agreed to conduct, under OLMS supervision, new nominations and a new election for the offices of President; Vice-President; Recording Secretary; New Hampshire Executive Board; and Branch Presidents of Northern Hasp, Springfield, Mass., and Brockton, Mass. The OLMS investigation revealed that the local union failed to provide ballots to all members, and allowed ineligible members to vote. The agreement follows an investigation by the OLMS Boston District Office and New Haven Resident Investigator Office.

On July 11, 2008, OLMS entered into a voluntary compliance agreement with American Postal Workers Union (APWU) Local 185 (located in Houston, Texas), concerning a challenged election conducted on December 14, 2007.  The union agreed to use the results of the OLMS recount of ballots as the official election results to send delegates to either the APWU National Convention or the APWU Texas State Convention. The OLMS investigation disclosed that the union failed to properly count the ballots for certain delegate positions.  The agreement follows an investigation by the OLMS Houston Resident Investigative Office. 

On July 2, 2008, OLMS entered into a voluntary compliance agreement with the Carnegie Mellon Campus Police Association (CMCPA) (located in Pittsburgh, Pa.) concerning the election of officers conducted on March 20, 2008. The CMCPA agreed to conduct a runoff election under OLMS supervision for the position of vice president. The OLMS investigation of the challenged election disclosed that the union’s constitution and bylaws were violated when the vice president was declared the winner despite not being elected by a majority of the eligible votes cast.  The agreement follows an investigation by the OLMS Pittsburgh District Office. 

On June 19, 2008, OLMS entered into a voluntary compliance agreement with the American Federation of Government Employees (AFGE) National Union (located in Washington, DC) and AFGE Local 2883 (located in Decatur, GA), concerning a challenged re-run election conducted by the AFGE 5th District for the office of president of AFGE Local 2883 on October 30, 2007. The unions agreed to conduct, under OLMS supervision, new nominations and a new election for the office of president.  The OLMS investigation revealed that some union members did not receive an election ballot; the union failed to provide the right to inspect the membership list once within 30 days of the re-run election; and the union failed to provide the right to have an observer at various stages of the re-run election. The agreement follows an investigation by the OLMS Atlanta District Office.

On June 10, 2008, OLMS entered into a voluntary compliance agreement with Mail Handlers Local 305 (located in Richmond, VA), concerning a challenged election of national delegates conducted on March 12, 2008. Local 305 agreed to conduct a new election under OLMS supervision for 17 delegates. The OLMS investigation disclosed that the union newspaper was used for campaign purposes. The agreement follows an investigation by the OLMS Washington District Office.

On April 25, 2008, the Department entered into a voluntary compliance agreement with the Studio Security & Fire Association (SSFA) (located in Burbank, Ca.), concerning a challenged election held in August 2007.  SSFA agreed to conduct new nominations and a new election under OLMS supervision for the positions of president, vice president, treasurer, recording secretary, and governor.  The OLMS investigation concluded that SSFA failed to provide a reasonable opportunity to nominate candidates when it failed to notify its membership of its decision to suspend a meeting-attendance qualification.   In addition, SSFA allowed an incumbent officer to use union funds to campaign when that officer sent a letter on union stationary to the SSFA members at union expense criticizing two candidates during the election.  The voluntary compliance agreement follows an investigation by the OLMS Los Angeles District Office.

On April 22, 2008, the Department entered into a voluntary compliance agreement with Operating Engineers Local 547 (located in Detroit, Mich.) concerning the challenged election of officers conducted on August 31, 2007.  In that election, some candidates were not notified that they could identify and list themselves as a slate on the election ballot.  The local has agreed to conduct new nominations, if necessary, and a new election under OLMS supervision for the offices of business manager, vice president, recording secretary, financial secretary, treasurer, three trustees, and three auditors.  The agreement follows an investigation by the OLMS Detroit District Office.

On March 17, 2008, the Department entered into a voluntary compliance agreement with UAW Local 551 in Chicago, Illinois, concerning the challenged election of officers conducted on June 5 and 12, 2007.  In that election, some retired members were not mailed a nomination or election notice. The local has agreed to conduct new nominations and a new election under OLMS supervision for the offices of president, vice president, recording secretary, financial secretary, three trustees, guide, and sergeant-at-arms. The agreement follows an investigation by the OLMS Chicago District Office. 

On January 9, 2008, the Department accepted a voluntary compliance agreement from Sindicato de Guardias de Seguridad de Puerto Rico, a local labor union in Rio Piedras, Puerto Rico. The agreement calls for the Department to supervise an election for local union officers on or before March 31, 2008. The agreement stems from the union’s failure to conduct an officer election within three years of its last regular election. The agreement follows an investigation by the OLMS Atlanta District Office.

 

2007


On December 14, 2007, the Department entered into a voluntary compliance agreement with the American Federation of Television and Radio Artists (AFTRA) Los Angeles Local concerning the challenged election of officers conducted on May 22, 2007. In that election, some members were mailed a ballot and election notice packet less than fifteen days prior to the date that ballots must have been returned in order to be counted. Also, there were errors in the tallying of ballots. The local agreed to conduct a new election for the nine Los Angeles Board of Director for Actors officer positions and the thirteen National Board of Directors officer positions that may have been affected by the violations. The voluntary compliance agreement follows an investigation by the Los Angeles District Office.

On November 30, 2007, the Department entered into a voluntary compliance agreement with Asbestos Workers Local 74 in Des Moines, Iowa, concerning the challenged election of officers conducted on May 8, 2007. In that election, nominees were improperly disqualified on the basis of a new dues payment policy of which they did not have sufficient notice. Local 74 agreed to conduct new nominations and a new election for business manager/financial secretary, five executive board members, and sergeant of arms under OLMS supervision. The voluntary compliance agreement follows an investigation by the OLMS Kansas City Resident Investigator Office.

On October 15, 2007, the Department entered into a voluntary compliance agreement with AFGE Local 1105 concerning a challenged election conducted on December 7, 2006. During the election, Local 1105 failed to elect its officers by secret ballot when adequate facilities were not provided to ensure voters privacy. Local 1105 also failed to: follow its constitution with respect to the time period for submitting nominations; properly notify all members of nominations and the election; maintain adequate safeguards over the ballots and ballot box; and maintain all election records for one year. Local 1105 agreed to conduct new nominations and a new election under OLMS supervision for the offices of president, vice president, secretary, treasurer, chief steward and delegate. The voluntary compliance agreement follows an investigation by the OLMS Denver District Office.

On August 28, 2007, the Department entered into a voluntary compliance agreement with the Brotherhood of Locomotive Engineers and Trainmen (BLET), Division 1 concerning a challenged election conducted on December 6, 2006. During the election, Division 1 failed to provide adequate safeguards where ballots were printed at the home of one of the candidates, records were not maintained to allow for a ballot reconciliation, undeliverable ballots were returned to the residence of one of the candidates, and candidates had access to the post office box for voted ballots. In addition, Division 1 failed to follow its bylaws provisions concerning a tie vote, and did not send both notice of the election and ballots to members who may have been in good standing or could have brought themselves into good standing before the election. Division 1 agreed to conduct new nominations, if necessary, and a new election under OLMS supervision for the offices of Vice President, Local Chairman-Norfolk Southern, Local Chairman-Conrail, two Vice Local Chairman-Conrail, Delegate to the State Legislative Board, and Delegate to the National Division. The voluntary compliance agreement follows an investigation by the OLMS Detroit District Office.

On August 24, 2007, the Department entered into a voluntary compliance agreement with Service Employees International Union (SEIU) Local 2001, Chapter 96 concerning a challenged election conducted on March 9, 2007. During the election, Local 2001, Chapter 96 failed to elect its officers by secret ballot where adequate facilities were not provided to ensure voter privacy or secrecy when voting. In addition, voted ballots were handed directly to union staff members running the polling site, in violation of the LMRDA. Local 2001, Chapter 96 agreed to conduct new nominations, if necessary, and a new election under OLMS supervision for the office of treasurer. The voluntary compliance agreement follows an investigation by the OLMS Boston District Office.

On July 2, 2007, the Department entered into a voluntary compliance agreement with American Federation of Government Employees Local 1547 concerning a challenged election conducted on November 21, 2006. During the election, a union officer obtained absentee ballots for the president's preferred candidate and provided them to union members to be cast. The local also failed to follow its constitution and bylaws which, prohibited a member of the election committee from being a candidate in an election. Local 1547 agreed to conduct new nominations and a new election under OLMS supervision for the offices of treasurer and administrative vice president. The voluntary compliance agreement follows an investigation by the OLMS Los Angeles District Office.

On June 19, 2007, the Department entered into a voluntary compliance agreement with the International Association of Machinists and Aerospace Workers (IAM) Local Lodge 141, concerning a challenged election held in December 2006. IAM LL 141 agreed to conduct new nominations (if necessary) and a new election under OLMS supervision for the conductor/sentinel position and two of the three trustee positions. IAM LL 141 failed to contact members about their lapsed dues and allowed some ineligible members to vote in the election in violation of LMRDA section 401(e). The voluntary compliance agreement follows an investigation by the OLMS Detroit District Office.

On June 18, 2007, the Department entered into a voluntary compliance agreement with Stage & Picture Operators AFL-CIO, Local 871 concerning a challenged election conducted on December 11, 2006. Investigation disclosed that the union did not treat candidates equally with respect to the distribution of campaign literature and the posting of material on the union website. The union also may have failed to count some votes from eligible members. Local 871 agreed to conduct new nominations and a new election under OLMS supervision for the offices of president, vice president, treasurer, board of directors (10), and delegates (15), prior to October 31, 2007. The voluntary compliance agreement follows an investigation by the OLMS Los Angeles District Office.

On June 12, 2007, the Department entered into a voluntary compliance agreement with Transport Workers Local 241 in New York City concerning a challenged election conducted on November 8, 2006. An OLMS investigation established that Local 241 failed to provide adequate safeguards when it failed verify that the sign-in roster did not match the number of ballots cast. Local 241 agreed to conduct a new election for the offices of president, vice president, recording secretary, and 2nd and 3rd executive board at-large members under OLMS supervision. The agreement follows an investigation by the New York District Office.

On June 11, 2007, the Department entered into a voluntary compliance agreement with the Brotherhood of Locomotive Engineers and Trainmen, IBT (BLET) Division 192, concerning a challenged election held in December 2006. BLET Division 192 agreed to conduct new nominations and a new election under OLMS supervision for the position of Local Chairman. BLET Division 192 failed to provide adequate safeguards during the election when it failed to count a valid ballot while counting invalid ballots. The voluntary compliance agreement follows an investigation by the OLMS Dallas District Office.

On May 23, 2007, the Department entered into a voluntary compliance agreement with Local 2341 of the American Federation of Government Employees (AFGE) in New Orleans, Louisiana, concerning a challenged election of officers conducted on November 29, 2006. AFGE Local 2341 agrees to conduct a run-off election for the position of secretary treasurer under the supervision of the Secretary of Labor because the OLMS recount of ballots resulted in a tie vote and AFGE requires a majority to elect. In the event that one of the two secretary treasurer candidates declines to participate in the run-off, new nominations will be conducted for this position. The voluntary compliance agreement follows an investigation by the OLMS New Orleans District Office.

On April 16, 2007, the Department entered into a voluntary compliance agreement with the International Federation of Professional & Technical Engineers (IFPTE) Local 259, concerning a complaint that the 2006 regular election of officers had not been held in violation of LMRDA section 401(b). To remedy their failure to hold an election, IFPTE Local 259 agreed to conduct nominations and an election under OLMS supervision for President, First Vice President, Second Vice President, Third Vice President, Chief Steward, Secretary, and Treasurer. The voluntary compliance agreement follows an investigation by the OLMS Nashville District Office.

On March 27, 2007, the Department entered into a voluntary compliance agreement with the Allied Pilots Association (APA) St. Louis Domicile concerning a challenged election conducted in March 2006. The OLMS investigation found that observers were not permitted during all phases of the election process as required by Section 401(c) of the LMRDA. In addition, there was a failure to elect by secret ballot as required by Section 401(e) of the Act. The APA agrees that OLMS will supervise an election for the positions of chairman and vice chairman of the St. Louis Domicile. The voluntary compliance agreement follows an investigation by the OLMS St. Louis District Office.

On February 20, 2007, the Department entered into a voluntary compliance agreement with Letter Carriers Branch 53 in Jacksonville, Florida concerning a challenged election conducted on August 9, 2006. Branch 53 agreed to conduct new nominations and a new election under the supervision of OLMS for the uncontested positions of president, executive vice president, recording secretary, financial secretary and five trustees. The voluntary compliance agreement follows an investigation by the OLMS Atlanta District Office.

On January 23, 2007, the Department entered into a voluntary settlement agreement with PACE Local 5-772 in Memphis, Tennessee concerning the failure of the local to hold an election in January 2006. Local 5-772 agreed to conduct nominations, an election, and the installation of officers for the offices of President, Vice-President of Memphis (MEM), Vice-President of Detroit (DTW), Vice-President of Minneapolis (MSP), Recording Secretary, Treasurer, and three Trustee positions prior to May 31, 2007 under the supervision of the Secretary of Labor. The settlement agreement follows an investigation by the OLMS Nashville District Office.

On January 18, 2007, the Department entered into a voluntary compliance agreement with Carpenters Local 58 concerning a challenged election conducted on June 13, 2006. Local 58 agreed to conduct new nominations and a new election under OLMS supervision for five delegates to the Chicago Regional Council of Carpenters. The voluntary compliance agreement follows an investigation by the OLMS Chicago District Office.

On January 17, 2007, the Department entered into a voluntary compliance agreement with National Postal Mail Handlers Union Local 312 concerning a challenged election conducted on July 22, 2006. Local 312 agreed to conduct new nominations and a new election under OLMS supervision for seven offices. The voluntary compliance agreement follows an investigation by the OLMS New Orleans District Office.

On December 12, 2006 the Department entered into a voluntary compliance agreement with the JL French Employee Committee in Sheboygan, Wisconsin, concerning the challenged June 20, 2006 election of chairperson. The JL French Employee Committee agreed to conduct a new election for the office of chairperson under OLMS supervision. The compliance agreement follows an investigation by the OLMS Milwaukee District Office.

On December 11, 2006, the Department entered into a voluntary compliance agreement with IATSE Local 500 in Oakland Park, Florida concerning the challenged June 3, 2006 election of officers. Local 500 agreed to conduct a new election for the offices of president, vice president, and secretary/business representative under OLMS supervision. The compliance agreement follows an investigation by the OLMS Atlanta District Office.

On November 10, 2006, the Department entered into a voluntary compliance agreement with Carpenters Local 272 concerning a challenged election conducted on June 12, 2006. Local 272 agreed to conduct nominations, an election, and installation under OLMS supervision for one delegate to the Chicago Regional Council of Carpenters. The voluntary compliance agreement follows an investigation by the OLMS Chicago District Office.

On November 2, 2006, the Department entered into a voluntary compliance agreement with American Federation of Government Employees Local 1972 concerning a challenged election conducted on February 14, 2006. Local 1972 agreed to conduct a new election under OLMS supervision for the offices of first vice president and vice president of professionals. The voluntary compliance agreement follows an investigation by the OLMS New Orleans District Office.

On October 18, 2006, the Department entered into a voluntary compliance agreement with Communications Workers of America Local 1400 concerning a challenged election for District One Vice President conducted on April 6, 2006. Local 1400 agreed to conduct a new election for District One Vice President under OLMS supervision. The voluntary compliance agreement follows an investigation by the OLMS Boston District Office.

On October 13, 2006, the Department entered into a voluntary compliance agreement with United Steelworkers Local 11-0001 concerning a challenged election of officers conducted on March 14, 2006. Local 11-0001 agreed to conduct new nominations and election for the offices of president and trustee. The voluntary compliance agreement follows an investigation by the OLMS Denver District Office.

On July 24, 2006, the Department entered into a voluntary compliance agreement with the Transport Workers Union of America, Air Transport Local 564, concerning a challenged election of officers conducted on December 15, 2005. Local 564 agreed to conduct a new election under OLMS supervision for the office of northern executive board member. The voluntary compliance agreement follows an investigation by the OLMS Los Angles District Office.

On July 20, 2006, the Department entered into a voluntary compliance agreement with American Postal Workers Union Local 28 concerning a challenged election of officers conducted by the local on December 2, 2005. The union agreed to conduct a new election under OLMS supervision for the offices of secretary, sergeant-at-arms, one trustee, and one delegate to the state convention. The voluntary compliance agreement follows an investigation by the OLMS Seattle District Office.

On July 12, 2006, the Department entered into a voluntary compliance agreement with Sindicato de Equipo Pesado Construccion Y Ramas concerning a complaint that the union failed to hold its January 2006 election of officers. The union agreed to conduct nominations and an election under OLMS supervision. The voluntary compliance agreement follows an investigation by the OLMS Puerto Rico Resident Investigator Office.

On June 12, 2006, the Department entered into a voluntary compliance agreement with American Federation of Government Employees (AFGE) concerning the challenged election conducted by AFGE Local 506. AFGE agreed to a new election conducted under OLMS supervision for the offices of president, executive vice president, vice president (low facility), vice president (medium facility), vice president (USP 1 facility), treasurer, and secretary. The voluntary agreement follows an investigation by the OLMS Atlanta District Office.

On May 24, 2006, the Department entered into a voluntary compliance agreement with United Steelworkers PACE Local 730 concerning a challenged election of officers conducted by the local on December 14, 2005. The union agreed to conduct a new election under OLMS supervision for the offices of president/delegate, vice president, chief steward, assistant chief steward, recording and corresponding secretary, financial secretary/treasurer, 3 trustees, and 2 sergeant-at-arms. The voluntary agreement follows an investigation by the OLMS Cleveland District Office.

On May 18, 2006, the Department entered into a voluntary compliance agreement with the National Treasury Employees Union, Chapter 98, concerning a challenged election of officers conducted on October 12-14, 2004. Chapter 98 agreed to conduct new nominations and a new election under OLMS supervision for the office of second vice president. The voluntary compliance agreement follows an investigation by the OLMS Nashville District Office.

On April 6, 2006, the Department entered into a voluntary compliance agreement with the Laborers International Union concerning a challenged election of officers conducted by Laborers Local 89 on June 11, 2005. The Laborers International, which currently has the local under trusteeship, agreed to conduct new nominations and a new election in Local 89 under OLMS supervision for all officer positions when the local is brought out of trusteeship. The voluntary compliance agreement follows an investigation by the OLMS Los Angeles District Office.

On March 20, 2006, the Department entered into a voluntary compliance agreement with American Postal Workers Union Local 359 in Huntsville, Alabama, concerning a challenged election of officers conducted by the local on October 25, 2005. Local 359 agreed to conduct a new election under OLMS supervision for the offices of President and Maintenance Craft Director. The voluntary compliance agreement follows an investigation by the OLMS Nashville District Office.

On March 7, 2006, the Department entered into a voluntary compliance agreement with Communications Workers, Local 6132, concerning a challenged election of officers conducted on September 29, 2005. Local 6132 agreed to conduct a new election under OLMS supervision for the offices of president, 2nd vice president, secretary-treasurer and chief steward marketing. The voluntary compliance agreement follows an investigation by the OLMS New Orleans District Office.

On February 24, 2006, the Department entered into a voluntary compliance agreement with Laborers Local 132 concerning a challenged election of officers conducted by Local 132 on June 11, 2005. The local union agreed to conduct new nominations and a new election in Local 132 under OLMS supervision for the positions of Secretary-Treasurer and Business Manager. The voluntary compliance agreement follows an investigation by the OLMS Minneapolis Resident Investigative Office.

On February 14, 2006, the Department entered into a voluntary compliance agreement with United Auto Workers Local 235 concerning a challenged May 19, 2005 election of officers. Local 235 agreed to conduct new nominations and a new election under OLMS supervision for the office of Vice-President. The voluntary compliance agreement follows an investigation by the OLMS Detroit District Office.

On January 18, 2006, the Department entered into a voluntary compliance agreement with the National Treasury Employees Union (NTEU), Chapter 282, concerning a challenged election of officers conducted on October 14, 2004. Chapter 282 agreed to conduct new nominations and a new election under OLMS supervision for the office of chapter president. The voluntary compliance agreement follows an investigation by the OLMS Washington District Office.

On January 12, 2006, the Secretary entered into a voluntary compliance agreement with the American Postal Workers Union (APWU) Local 89 concerning a challenged election of officers conducted on June 10, 2005. APWU Local 89 has agreed to conduct a new election for the office of Director of Industrial Relations under OLMS supervision. The voluntary compliance agreement follows an investigation by the Philadelphia District Office.

On January 4, 2006, the Department entered into a voluntary compliance agreement with Electrical Workers (IBEW) LU 1228, Newton, Massachusetts, concerning a challenged election of officers conducted on June 4, 2005. Local 1228 agreed to conduct new nominations and a new election for the offices of president, vice president, business manager/financial secretary/international convention delegate, two international convention delegates, and two alternate convention delegates under OLMS supervision. The voluntary compliance agreement follows an investigation by the OLMS Boston District Office.

On December 5, 2005, the Department entered into a voluntary compliance agreement with the Bell Production Engineering Association, concerning a challenged election of officers conducted on September 14, 2005. The Association agreed to conduct a new election under OLMS supervision for president and zone 3 committeeman. The voluntary compliance agreement follows an investigation by the OLMS Dallas District Office.

On October 25, 2005, the Department entered into a voluntary compliance agreement with the Indian Educators Federation (IEF), Local 4524, American Federation of Teachers, concerning a challenged local election of officers conducted December 1, 2004. IEF Local 4524 represents approximately 1500 teachers and school employees of the U.S. Department of the Interior, Bureau of Indian Affairs and Office of Special Trustees schools located in 20 states. Local 4524 agreed to conduct a new election under the supervision of OLMS for the offices of Executive Vice President, Treasurer, and Regions II, III and IV Vice Presidents. The voluntary compliance agreement follows an investigation by the OLMS Denver District Office.

On October 21, 2005, the Department entered into a voluntary compliance agreement with American Postal Workers Union Local 199, concerning a challenged local election of officers conducted April 5, 2005. Local 199 agreed to conduct a new election under OLMS supervision for the offices of President, Clerk Craft Director, Director of Industrial Relations, Assistant Treasurer, Board Members-at-large Maintenance Craft, Board Members-at-large Motor Vehicle Craft, and all state convention delegates. The voluntary compliance agreement follows an investigation by the OLMS Washington District Office.

On October 19, 2005, the Department entered into a voluntary compliance agreement with the American Train Dispatchers Association (ADTA) concerning a challenged election of the Burlington Northern and Santa Fe System Committee conducted December 15, 2004. The American Train Dispatchers Association agreed to conduct new nominations and election under OLMS supervision for six offices of Vice General Chairman/Local Chairman/Fort Worth Delegate of ATDA's Burlington Northern and Santa Fe System Committee. The voluntary compliance agreement follows an investigation by the OLMS Dallas District Office.

On October 17, 2005, the Department entered into a voluntary compliance agreement with the 4,000 plus member Hawaii Nurses Association, concerning a challenged election of officers conducted on March 28, 2005. The Association agreed to conduct new nominations and a new election under OLMS supervision for President, Vice-President, Secretary, Treasurer, District Board of Directors (14), and Bargaining Unit Board of Directors (20). The voluntary compliance agreement follows an investigation by the OLMS Honolulu Resident Investigative Office.

On October 13, 2005, the Department entered into a voluntary agreement with Machinists Local Lodge 1746, concerning the challenged local lodge election of officers that was conducted April 20, 2005. Local Lodge 1746 agreed to allow the Secretary of Labor to supervise a new election for president, vice president, conductor-sentinel, and three trustees. The voluntary agreement follows an investigation by the OLMS New Haven Resident Investigator Office.

On October 6, 2005, the Department entered into a voluntary compliance agreement with the National Association of Letter Carriers, Branch 39, concerning a challenged local election of officers conducted March 16, 2005. Branch 39 agreed to conduct a new election under OLMS supervision for the offices of President, Vice-President, and Trustees. The voluntary compliance agreement follows an investigation by the OLMS Cincinnati District Office.

On October 5, 2005, the Department entered into a voluntary compliance agreement with the American Federation of Government Employees (AFGE), Local 1843, concerning a challenged election of officers conducted on March 30, 2005. Local 1843 agreed to conduct a new election under OLMS supervision for the offices of vice-president and chief steward. The voluntary compliance agreement follows an investigation by the OLMS New York District Office.

On August 29, 2005, the Department entered into a voluntary agreement with the American Federation of Government Employees (AFGE) and an affiliated local union, Local 1738, concerning the challenged Local 1738 election of officers that was completed December 4, 2004, in Salisbury, North Carolina. AFGE and Local 1738 agreed to allow the Secretary of Labor to supervise a new election for president, vice president-Fayetteville, vice president-Durham, trustee, and chief steward. This voluntary agreement resulted from an investigation by the OLMS Nashville District Office.
