                                                                                    LM File No. 015-386

Mark L. Bruemmer, Treasurer
Teamsters Local 833
230 West Dunklin Street
Jefferson City, MO 65101

Dear Mr. Bruemmer:

This is in response to your continuing hardship exemption request for Teamsters Local 833, LM File Number 015-386, for the fiscal year ending December 31, 2010.  Your request dated March 17, 2011 was received by the Office of Labor-Management Standards (OLMS) on March 17, 2011.  A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.

You based your request upon the following information stated in your letter:

Your accountant prepared your Form LM-2 report using the Adobe version of the form rather than the new web-based version.  You are unable to sign and submit the form, because your union’s computers have a newer version of Abobe Reader installed that is incompatible with the form.  You were advised that installing the older compatible version of Adobe Reader on your computers is not possible, because it would compromise your firewalls.
OLMS grants your continuing hardship exemption request for filing the Form LM-2 electronically for the fiscal year ending December 31, 2010, based on the technical difficulties that you encountered.  You indicated in a telephone conversation with a member of my staff that you have sent a signed completed hardcopy Form LM-2 report to the OLMS Division of Reports, Disclosure, and Audits.
If you have any further questions about filing the Form LM-2 pursuant to the hardship exemption, please call 202-693-0123 and reference your organization’s LM file number.

Sincerely,

Andrew R. Davis, Chief
Division of Interpretations
  and Standards

cc: Larry King, Chief, Division of Reports, Disclosure, & Audits
