This is in response to your continuing hardship exemption request for the Security Officers Union, Local One, LM File Number 541-271, for the fiscal year ending December 31, 2009. Your request dated August 18, 2010 was received by the Office of Labor-Management Standards (OLMS) on August 18, 2010. A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.
You based your request upon the following information stated in your letter:
Your local made numerous failed attempts to electronically file your Form LM-2 report. Subsequently, you contacted OLMS software support for assistance and were told that you could not file your LM-2 report electronically due to software compatibility issues, which corrupted the electronic Form LM-2 report.
OLMS grants your continuing hardship exemption request for filing Form LM-2 electronically for the fiscal year ending December 31, 2009, based on the information provided, as your attempts to file electronically were unsuccessful and resulted in corrupting the Form LM-2 report. Further, you filed a paper copy of your Form LM-2 report with OLMS on March 31, 2010.
