This is in response to your continuing hardship exemption request for the International Brotherhood of Electrical Workers, Local 817, LM File Number 049-836, for the fiscal year ending June 30, 2010. Your request dated September 24, 2010 was received by the Office of Labor-Management Standards (OLMS) on September 24, 2010. A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.
In the past, your union has filed a Form LM-3 report. This is the first year your union has been required to file a Form LM-2 report, and you have discovered software incompatibility issues that make it difficult for you to submit the report electronically.
OLMS grants your continuing hardship exemption request for filing Form LM-2 electronically for the fiscal year ending June 30, 2010, as a result of the software incompatibility issues. Your accountant has indicated that you are mailing a paper copy of your LM-2 to OLMS before the due date.
