This is in response to your continuing hardship exemption request for the Professional Hockey Players’ Association, LM File Number 516-974, for the fiscal year ending April 30, 2010. Your request dated July 28, 2010 was received by the Office of Labor-Management Standards (OLMS) on July 28, 2010. You also filed a paper copy of your Form LM-2 report with OLMS on July 28, 2010. A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.
In your letter, you detailed the numerous attempts that you have made to comply with the requirement to file your Form LM-2 report electronically, and the technical difficulties that you encountered in validating and electronically filing your form, such as incompatibility of certain software with the electronic Form LM-2.
OLMS grants your continuing hardship exemption request for filing Form LM-2 electronically for the fiscal year ending April 30, 2010, based on the information provided, as you made numerous attempts to file electronically but were unable to do so because of technical difficulties encountered.
