This is in response to your continuing hardship exemption request for United Transportation Union Local 0577, LM File Number 037-953, for the fiscal year ending December 31, 2008. Your request dated July 29, 2009 was received by the Office of Labor-Management Standards (OLMS) on August 4, 2009. A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.
You based your request upon the following information stated in your letter:
Your president’s digital signature had expired, and he has since had trouble renewing it. After many attempts, the signature was renewed, but you are unable to download it to the form.
OLMS denies your continuing hardship exemption request for filing Form LM-2 electronically for the fiscal year ending December 31, 2008, based on the information provided, as your request for a hardship exemption does not provide adequate justification for the request, such as whether or not you made any attempts to contact IdenTrust or the Department to correctly download the form, or explain the burden and expense that your union would incur if it was required to make an electronic submission. I also note that your request was not received within thirty days prior to the required due date of the report. Please contact the OLMS electronic forms help desk at 1-866-401-1109 for help in resolving your issues with your digital signatures.
