Dear Mr. Mooney:

This is in response to your continuing hardship exemption request for United Brotherhood of Carpenters and Joiners of America Local 9144, LM File Number 034-847, for the fiscal years ending June 30, 2008. Your request dated February 9, 2009 was received by the Office of Labor-Management Standards (OLMS) on February 11, 2009. A continuing hardship exemption request requires the requesting union to demonstrate that it cannot file Form LM-2 electronically without undue burden or expense.

You based your request upon the following information stated in your letter:

When you attempted to complete the electronic signature process to file your report electronically it did not work, due to an incompatibility with the version of Adobe that resided on one of the two computers used to maintain the digital signatures. You attempted to uninstall the incompatible version of Adobe and install a version that would work with the electronic LM-2, but were unable to do so. You filed a paper copy of your report with OLMS on October 1, 2008. In the future, your officers will maintain both signatures on one computer in the union office to avoid compatibility problems.

Based on the information provided, OLMS grants your continuing hardship exemption request for filing Form LM-2 electronically for the fiscal year ending June 30, 2008.
