UNITED STATES DEPARTMENT OF LABOR
BEFORE THE ASSISTANT SECRETARY
FOR EMPLOYMENT STANDARDS
IN THE MATTER OF
CHIEF, DIVISION OF ENFORCEMENT
OFFICE OF LABOR-MANAGEMENT STANDARDS
EMPLOYMENT STANDARDS ADMINISTRATION
COMPLAINANT
AND
CASE NO. -
NATIONAL TREASURY EMPLOYEES UNION CHAPTER 65
RESPONDENT
DECISION AND ORDER
This proceeding arose under the standards of conduct provisions of the Civil Service Reform Act
of 1978,5 U.S.C. 7120, and the implementing regulations, 29 CFR 457 et seq., as a result of a
complaint filed by the Chief, Division of Enforcement, Office of Labor-Management Standards,
Employment Standards Administration against Chapter 65 of the National Treasury Employees
Union regarding the installation of George Bergmann and Betty King into the positions of
financial vice president and parliamentary vice president, respectively, to which they were duly
elected in the May 21, 1999 election of officers. On December 19,2000, Administrative Law
Judge Linda S. Chapman issued a Recommended Decision and Order approving a Stipulated
Agreement in which the parties acknowledged that the Respondent had installed Mr. Bergmann
and Ms. King into their positions. Since no exceptions to the Recommended Decision and Order
were filed, it is hereby adopted and incorporated without discussion, pursuant to sections 458.70
and 458.91 of the Department's regulations.
ORDER
IT IS HEREBY ORDERED, THAT, since the duly elected officers were properly installed into
their positions, this case be, and it hereby is, dismissed.
