Dear James Hagan Jr.:
This office has recently completed an audit of UTU Local 1365 under the Compliance Audit Program (CAP) to determine your organization’s compliance with the provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). As discussed during the exit interview with you on January 28, 2014, the following problems were disclosed during the CAP. The matters listed below are not an exhaustive list of all possible problem areas since the audit conducted was limited in scope.
Reporting Violations
Failure to File Bylaws
The audit disclosed a violation of LMRDA Section 201(a), which requires that a union submit a copy of its revised constitution and bylaws with its LM report when it makes changes to its constitution or bylaws. Local 1365 amended its constitution and bylaws in 2012, but did not file a copy with its LM report for that year.
Local 1365 has now filed a copy of its constitution and bylaws.
Other Issues
Bank Account Signatories
The audit disclosed that a member who no longer holds union office is listed as owner of the union bank account. In order to maintain adequate internal financial controls, Local 1365 should update the union’s bank account to reflect only the current authorized users.
LM Report Signatures
The LM-3 report for fiscal year 2012 was signed by one officer, instead of both principle executive and financial officers, as required by the LMRDA. Ensure that both the president and secretary-treasurer sign future reports.
