Dear Mr. Castelluzzo:

This office has recently completed an audit of Electrical Workers (UE), Local 404 under the Compliance Audit Program (CAP) to determine your organization’s compliance with the provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). As discussed during the exit interview with you on April 24, 2013, no violations of the LMRDA were disclosed in areas of financial activity included in the CAP. This does not exhaust all possible problem areas, however, since the audit conducted was limited in scope and did not include all areas of your union’s operation.

I want to extend my personal appreciation to Electrical Workers (UE), Local 404 for the cooperation and courtesy extended during this compliance audit. As we discussed, I recommend that in the future you keep a journal of receipts and disbursements in addition to employer dues check-off statements and check stubs.

You have stated that Local 404 is likely to be terminated in the near future by merger into another local of the UE. When that occurs, you will be required to file, within 30 days, a terminal LM-3 Report covering the period from the beginning of your fiscal year (May 1, 2013) through the date of termination. In item #56, “Additional Information”, you would have to state what was done with the remaining assets of Local 404. I strongly recommend that you make sure this letter and the compliance assistance materials provided to you are passed on to future officers. If we can provide any additional assistance, please do not hesitate to call.
