Dear Mr. Gillenwater:
This office has recently completed an audit of Oil Workers of Cincinnati under the Compliance Audit Program (CAP) to determine your organization’s compliance with the provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). As discussed during the exit interview on September 29, 2010, the following problems were disclosed during the CAP. The matters listed below are not an exhaustive list of all possible problem areas since the audit conducted was limited in scope.
Other Violation
The audit disclosed a violation of LMRDA Section 201(b):
The Oil Workers of Cincinnati was required to file a Labor Organization Annual Report Form LM-4 by June 29, 2010, or 90 days after the end of its 2010 fiscal year. The report was received by the Department of Labor on September 29, 2010. Since the union has terminated, OLMS will take no further enforcement action regarding this issue.
