Dear Mr. Stark:
This office has recently completed an audit of Laborers Local 1032 under the Compliance Audit Program (CAP) to determine your organization’s compliance with the provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). During the audit, it was determined that the membership of Local 1032 is made up of only public sector employees, i.e. police and corrections officers. Unions that are comprised only of public sector employees are not subject to the LMRDA or Office of Labor-Management Standards (OLMS) reporting requirements.
The recordkeeping and reporting violations discovered during the audit were discussed with you and Local 42 Business Manager/Secretary-Treasurer Brandon Flinn. Although there were significant reporting violations, Local 1032 is not required to file an amended LM-3 report for 2009 due to the reason mentioned above.
During the audit, it was revealed that Local 1032 has been ordered by LIUNA to merge with Local 42. Normally, OLMS requires a local that has merged or terminated to file a terminal LM-3 report; however, due to the reason mentioned above, Local 1032 is not required to file a terminal LM-3 report for 2010.
