This office has recently completed an audit of Teamsters Local 877 under the Compliance Audit Program (CAP) to determine your organization’s compliance with the provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). As discussed during the exit interview with on September 24, 2010, the following problems were disclosed during the CAP. The matters listed below are not an exhaustive list of all possible problem areas since the audit conducted was limited in scope.
The CAP disclosed the following:
Act Section 201 (29 U.S.C. 431) requires the yearly filing of financial reports including information in such detail as to accurately disclose the labor organization’s financial condition and operations for its preceding fiscal year. The audit included examination and testing of assertions contained in the LM-2 filing made for calendar years 2009. Review of Item #22(B) discloses the need to include the confirmed balance of $86,769.98 at Sovereign Bank. Item #40 requires the accrued interest of $1,766.91 for that same account. Employers invoice the local union for lost-time wages paid while engaged in union business. The balance payable to Conoco-Philips of $32,452.10 at year end needs to appear in item #30(B).
Amended, signed, original form LM-2 for year 2009 should be completed and received at this office no later than Monday, November 14, 2010.
