Dear Mr. Ames:
This office has recently completed an audit of the Empire State Building Trades Council, under the Compliance Audit Program (CAP), to determine your organization’s compliance with the provisions of the Labor-Management Reporting and Disclosure Act (LMRDA). As discussed during the exit interview with you on March 11, 2010, the following problems were disclosed during the CAP. The matters listed below are not an exhaustive list of all possible problem areas since the audit conducted was limited in scope.

The audit disclosed that the union does not collectively bargain, does not represent members, and was formed to advocate for a group of union’s. Pursuant to Section 3(i) of the LMRDA, the Empire State Building Trades Council is not a covered labor organization.
