Dear Mr. Donaldson:

This office has recently completed an audit of UAW Local 2147 for its fiscal year ended December 31, 2005, under the Compliance Audit Program (CAP) to determine your organization's compliance with the provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). As discussed during the exit interview with you on February 16, 2007, the following problems were disclosed during the CAP. The matters listed below are not an exhaustive list of all possible problem areas since the audit conducted was limited in scope.

The CAP disclosed a violation of LMRDA section 201(a) which requires that unions submit a copy of their current constitution and bylaws along with its next LM report. Local 2147 revised its bylaws effective December 11, 2000, but failed to file a copy of those revised bylaws with its LM-3 Report for its fiscal year ended December 31, 2000, or in any subsequent year.

A copy Of Local 2147's current bylaws was secured by during the compliance audit and will be forwarded to the Office of Labor-Management Standards (OLMS) National Office. Since you have agreed to file bylaw revisions in a timely fashion with OLMS in the future, no further action is being considered regarding this matter at the present time.
