This office has recently completed an audit of BMWE Lodge 633 under the Compliance Audit Program (CAP) to determine your organization's compliance with the provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). As discussed during the exit interview with you on January 19, 2007, the following problem was disclosed during the CAP. The matter listed below is not an exhaustive list of all possible problem areas since the audit conducted was limited in scope.
Title IV, Section 401(b) of the LMRDA states that every local labor organization must hold its regular officer elections at least once every three years by a secret ballot among the members in good standing. The audit of BMWE Lodge 633 disclosed that Lodge 633 has been holding its election of officers once every four years, which is in violation of Title IV.
As agree Lodge 633 will hold its next officer elections no later than three years from its last regularly scheduled elections, which were held November 2005 and provided for the installation of officer on January 1, 2006.
