Dear Mr. Grear:
This office has recently completed an audit of Mine Workers Local 1810 under the Compliance Audit Program (CAP) to determine your organization's compliance with the provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). As discussed during the exit interview with John Grear on July 19, 2006, the following problems were disclosed during the CAP. The matters listed below are not an exhaustive list of all possible problem areas since the audit conducted was limited in scope.
The CAP disclosed a violation of LMRDA section 201(b), because the Labor Organization Annual Report (Form LM-3) filed by Local 1810 for fiscal year ending December31, 2005 was deficient in the following areas:
Local 1810 needs to adjust the figures reported in Item 24 (All Officers and Disbursements to Officers) of the 2005 LM-3 report. Only officers designated by the UMWA constitution are to be reported in Item 24, and though these officers may receive income from performing other roles in the union, all compensation received must be reported once under the officers name in Item 24.
Local 1810 has corrected these deficiencies by the submission of a amended LM-3 report. No further action is required.
