- Step 1: “I work for an employer who has 50 or more employees, or I work for a public agency, elementary, or secondary school.” If none of those statements is true, your employer is not covered by the FMLA and does not have to offer FMLA leave. But if at least one of those statements is true, your employer is covered by the FMLA, and you can move on to step 2.
- Step 2: “I have worked for my employer for at least 12 months.” If this statement is not true, you are not eligible for FMLA leave. But if this statement is true, you may be eligible for FMLA leave, and you can move on to step 3.
- Step 3: “I have worked for my employer for at least 1,250 hours in the last 12 months.” If this statement is not true, you are not eligible for FMLA leave. But if this statement is true, you may be eligible for FMLA leave, and you can move on to step 4.
- Step 4: “My employer has 50 or more employees within 75 miles of my jobsite.” If this statement is not true, you are not eligible for FMLA leave. But if this statement is true, you are eligible for FMLA leave.
