NOTICE REGARDING EEO-1 TYPE 2 DATA FOIA REQUESTS: Due to the increased interest in this topic please be advised that if you have submitted a FOIA request for information regarding EEO-1 Type 2 data between the years of 2021 and 2022, any responsive information will be posted here if and when it becomes available. If you have submitted a request for EEO-1 Type 2 data for years 2016-2020, you can find this information here.
Requests on 2021 data
OFCCP is posting this information in response to several Freedom of Information Act (FOIA) requests the agency has received for the Type 2 Consolidated EEO-1 Report data (EEO-1 data) for all federal contractors for EEO-1 filing year 2021. OFCCP has received three or more requests for the same information and thus the agency will make any responsive information available for public inspection in its FOIA Reading Room if and when it becomes available, as required by FOIA. See 5 U.S.C. 552(a)(2)(D)(ii)(II). OFCCP currently only has the EEO-1 data for reporting year 2021 in its possession, this information is limited to that dataset.
After receiving these FOIA requests, consistent with Executive Order 12600 and Department of Labor FOIA regulations at 29 CFR 70.26, OFCCP notified federal contractors of the requests through several different methods, including (1) publication in the Federal Register; (2) postings on OFCCP’s website; (3) distribution to OFCCP’s GovDelivery listserv; (4) individualized e-mails to federal contractors; and (5) individualized letters sent through U.S. Mail to federal contractors. In these notices, OFCCP provided the opportunity for contractors to object to the disclosure of this information and informed contractors that if no objection to disclosure was received, the requested EEO-1 data would be disclosed.

The EEO-1 data posted here is limited to those federal contractors that either affirmatively agreed to, or did not object to, the release of their EEO-1 data in response to the multiple notifications OFCCP distributed. Without an objection to release, OFCCP has no legal basis to withhold disclosure under FOIA.
For contractors that have submitted objections, OFCCP is in the process of considering those objections and will make determinations as to whether the information provided must be disclosed or may be withheld under FOIA Exemption 4. In the event that OFCCP determines that a contractor’s EEO-1 data must be disclosed, OFCCP will provide the objecting contractor with written notice of its determination and a specified disclosure date, which will be set to occur at a reasonable time after the determination notice is issued.

This release only includes those entities that affirmatively consented to the release of their data.

This release satisfies several FOIA requests and is in response to a court order rendered in the U.S. District Court for the Northern District of California (Docket No. 3:22-cv-07182). This release includes contractors for whom we have received no objection from (data set 1) and additional entities that have affirmatively consented to the release of their data (data set 2).
Third release
This is the third partial release of Type 2 EEO-1 data for years 2016 through 2020. This release satisfies several FOIA requests and is in response to a court order rendered in the U.S. District Court for the Northern District of California (Docket No. 3:22-cv-07182). This latest release consolidates all previous releases in response to this FOIA request and includes an additional 162 reports of entities that were determined to be federal contractors but did not respond to our notice confirming their status as a federal contractor.

Data Adjustments
The Office of Federal Contract Compliance Programs (OFCCP) strives to provide accurate records in response to the FOIA requests for Type 2 Consolidated EEO-1 Report data (EEO-1 data) for all federal contractors for EEO-1 filing years 2016-2020, and in its endeavor to do so, has made corrections to the data posted in its online FOIA Library. Below, OFCCP has provided a timeline regarding changes made to the posted data. OFCCP will update the timeline as needed should any additional data updates or adjustments occur. OFCCP suggests data users periodically review the timeline to ensure they are utilizing the most updated information. Any time an inaccuracy has been corrected, the data sets will be updated online, and may be re-downloaded to ensure users have the most up-to-date records.
