Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance on June 29, 2020, applicable to workers of The Boeing
Company, Boeing Commercial Aircraft (BCA), including on-site
leased workers from ALKU Technologies LLC, American Cybersystems,
Apollo Professional Solutions Inc., Aquent LLC, Artech Information
Systems LLC, Ateeca Inc., Chipton Ross Inc., CTS Technical
Services Inc., Dunhill Staffing Systems Inc., ICONMA LLC, Insight
Global, Launchcode, Moseley Technical Services Inc., PDS Technical
Services, Searchpros Staffing LLC, Triad Systems International, US
Tech Solutions Inc., Veterans Sourcing Group LLC, Volt Services,
and Yoh Services, working in multiple cities throughout Missouri
(TA-W-95,935R) as described in the affirmative determination. The
Department’s Notice of determination was published in the Federal
Register on July 31, 2020 (85 FR 46183). The workers were engaged
in activities related to the production of commercial aircraft.
At the request of the state workforce office, the Department
reviewed the certification for workers of the subject firm.
The company reports that workers leased from 22nd Century
Technologies and Noble Tek were employed on-site at The Boeing
Company, Boeing Commercial Aircraft (BCA), working in multiple
cities throughout Missouri. The Department has determined that
these workers were sufficiently under the control of the subject
firm to be considered leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from 22nd Century
Technologies and Noble Tek, working on-site at The Boeing Company,
Boeing Commercial Aircraft (BCA), working in multiple cities
throughout Missouri.
The amended notice applicable to TA-W-95,935R is hereby
issued as follows:
"All workers of The Boeing Company, Boeing Commercial
Aircraft (BCA), including on-site leased workers from
ALKU Technologies LLC, American Cybersystems, Apollo
Professional Solutions Inc., Aquent LLC, Artech
Information Systems LLC, Ateeca Inc., Chipton Ross Inc.,
CTS Technical Services Inc., Dunhill Staffing Systems
Inc., ICONMA LLC, Insight Global, Launchcode, Moseley
Technical Services Inc., PDS Technical Services,
Searchpros Staffing LLC, Triad Systems International, US
Tech Solutions Inc., Veterans Sourcing Group LLC, Volt
Services, Yoh Services, 22nd Century Technologies, and
Noble Tek, working in multiple cities throughout
Missouri, who became totally or partially separated from
employment on or after May 21, 2019, through June 29,
2022, and all workers in the group threatened with total

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or
are threatened to become totally or partially separated; and
(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and
(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and
(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or
threat of separation and to the decline in the sales or
production of such firm.
The investigation was initiated in response to a petition
filed on May 27, 2020 by a company official on behalf of
workers and former workers of The Boeing Company, Boeing
Commercial Aircraft (BCA), working in multiple cities
throughout the United States, specifically, The Boeing

aerospace and defense corporation headquartered in Chicago,
Illinois. Workers of BCA-United States are engaged in activities
related to the production of commercial aircraft and the supply
of related services.
An earlier determination (TA-W-92,973; which expired on
September 5, 2019) covered the workers of The Boeing Company,
Boeing Commercial Aircraft (BCA), including on-site leased
workers from CTS Technical Services Inc. and Launch Technical
Workforce Solutions LLC, South Carolina (TA-W-95,935AA) but
did not include the workers covered under TA-W-95,935GG.
During the course of the investigation, information was
collected from the petition, the workers' firm and other
sources.
Section 222(a)(1) has been met because a significant
number or proportion of the workers in BCA-United States have
become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(A)(i) has been met because BCA-United
States sales and/or production have decreased absolutely.
Section 222(a)(2)(A)(ii) has been met because imports of
articles like or directly competitive with the commercial
aircraft produced by BCA-United States have increased during
the relevant period when compared to the representative base
period.
Finally, Section 222(a)(2)(A)(iii) has been met because
increased imports contributed importantly to worker group
separations and sales/production declines at BCA-United
States.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of BCA-United States,
who are engaged in activities related to the production of
commercial aircraft, meet the worker group certification
criteria under Section 222(a) of the Act, 19 U.S.C. § 2272(a).
In accordance with Section 223 of the Act, 19 U.S.C. § 2273, I
make the following certifications:

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or
are threatened to become totally or partially separated; and
(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and
(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and
(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or
threat of separation and to the decline in the sales or
production of such firm.
The investigation was initiated in response to a petition
filed on May 27, 2020 by a company official on behalf of
workers and former workers of The Boeing Company, Boeing
Commercial Aircraft (BCA), working in multiple cities
throughout the United States, specifically, The Boeing
Company, Boeing Commercial Aircraft (BCA), including on-site
leased workers from American Cybersystems, Apollo Professional

as "BCA-United States"). The workers' firm is a multinational
aerospace and defense corporation headquartered in Chicago,
Illinois. Workers of BCA-United States are engaged in activities
related to the production of commercial aircraft and the supply
of related services.
An earlier determination (TA-W-92,973; which expired on
September 5, 2019) covered the workers of The Boeing Company,
Boeing Commercial Aircraft (BCA), including on-site leased
workers from CTS Technical Services Inc. and Launch Technical
Workforce Solutions LLC, South Carolina (TA-W-95,935AA) but
did not include the workers covered under TA-W-95,935GG.
During the course of the investigation, information was
collected from the petition, the workers' firm and other
sources.
Section 222(a)(1) has been met because a significant
number or proportion of the workers in BCA-United States have
become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(A)(i) has been met because BCA-United
States sales and/or production have decreased absolutely.
Section 222(a)(2)(A)(ii) has been met because imports of
articles like or directly competitive with the commercial
aircraft produced by BCA-United States have increased during
the relevant period when compared to the representative base
period.
Finally, Section 222(a)(2)(A)(iii) has been met because
increased imports contributed importantly to worker group
separations and sales/production declines at BCA-United
States.

commercial aircraft, meet the worker group certification
criteria under Section 222(a) of the Act, 19 U.S.C. § 2272(a).
