Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or
are threatened to become totally or partially separated; and
(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and
(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and
(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or
threat of separation and to the decline in the sales or
production of such firm.
The investigation was initiated in response to a petition
filed on May 7, 2020 by the International Association of
Machinists & Aerospace Workers (IAMAW), District Lodge 751, on
behalf of workers and former workers of The Boeing Company,
Boeing Commercial Aircraft (BCA), including on-site leased
workers from ALKU Technologies LLC, Dunhill Staffing Systems
Inc., and Veterans Sourcing Group LLC, multiple cities
throughout Washington State (TA-W-95,914), The Boeing Company,
Boeing Commercial Aircraft (BCA), including on-site leased
workers from American Cybersystems Inc., Apollo Professional
Solutions Inc., Aquent LLC, Artech Information Systems LLC,
Ateeca Inc., Chipton Ross Inc., Chipton Ross Inc. (Nevada),
Collabera Inc., CTS Technical Services Inc., Iconma LLC,
Moseley Technical Services Inc., PDS Technical Services,
Searchpros Staffing LLC, Triad Systems International, US Tech
Solutions Inc., Volt Services Inc., and Yoh Services LLC,
multiple cities throughout Washington State (TA-W-95,914A),
The Boeing Company, Boeing Commercial Aircraft (BCA),
including on-site leased workers from Dunhill Staffing Systems
Inc. and Veterans Sourcing Group LLC, Portland, Oregon (TA-W-
92,914B), and The Boeing Company, Boeing Commercial Aircraft
(BCA), including on-site leased workers from Apollo
Professional Solutions Inc., Chipton Ross Inc., Chipton Ross
Inc. (Nevada), Collabera Inc., CTS Technical Services Inc.,
Iconma LLC, Moseley Technical Services Inc., PDS Technical
Services, Searchpros Staffing LLC, Triad Systems
International, US Tech Solutions Inc., Volt Services Inc., and
Yoh Services LLC, Portland, Oregon (TA-W-95,914C)(hereafter
referred to collectively as "BCA-Washington/Oregon"). The
workers' firm is a multinational aerospace and defense
corporation headquartered in Chicago, Illinois. Workers of BCA-
Washington/Oregon are engaged in activities related to the
production of commercial aircraft and the supply of related
services.
Workers of The Boeing Company, Boeing Commercial Aircraft
were eligible to apply for Trade Adjustment Assistance under an
earlier determination (TA-W-92,903; expired on February 27,
2020).
Section 222(a)(1) has been met because a significant
number or proportion of the workers in BCA-Washington/Oregon
have become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(A)(i) has been met because sales and/or
production by BCA-Washington/Oregon have decreased absolutely.
Section 222(a)(2)(A)(ii) has been met because imports of
articles like or directly competitive with those produced by
BCA-Washington/Oregon by have increased during the relevant
period when compared to the representative base period.
Section 222(a)(2)(A)(iii) has been met because increased
imports contributed importantly to worker group separations
and sales/production declines at BCA-Washington/Oregon.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of BCA-
Washington/Oregon, who are engaged in activities related to the
production of commercial aircraft, meet the worker group
certification criteria under Section 222(a) of the Act, 19
U.S.C. § 2272(a). In accordance with Section 223 of the Act, 19
U.S.C. § 2273, I make the following certification:
"All workers of The Boeing Company, Boeing Commercial
Aircraft (BCA), including on-site leased workers from
ALKU Technologies LLC, Dunhill Staffing Systems Inc., and
Veterans Sourcing Group LLC, multiple cities throughout
Washington State (TA-W-95,914), who became totally or
partially separated from employment on or after May 5,
2019, through two years from the date of certification,
leased workers from American Cybersystems Inc., Apollo
Professional Solutions Inc., Aquent LLC, Artech
Information Systems LLC, Ateeca Inc., Chipton Ross Inc.,
Chipton Ross Inc. (Nevada), Collabera Inc., CTS Technical
Services Inc., Iconma LLC, Moseley Technical Services
Inc., PDS Technical Services, Searchpros Staffing LLC,
Triad Systems International, US Tech Solutions Inc., Volt
Services Inc., and Yoh Services LLC, working onsite at
The Boeing Company, Boeing Commercial Aircraft (BCA),
multiple cities throughout Washington State (TA-W-
95,914A) who became totally or partially separated from
employment on or after February 28, 2020, through two years
from the date of certification, The Boeing Company, Boeing
Commercial Aircraft (BCA), including on-site leased
workers from Dunhill Staffing Systems Inc. and Veterans
Sourcing Group LLC, Portland, Oregon (TA-W-92,914B) who
became totally or partially separated from employment on or
after May 5, 2019, through two years from the date of
certification, and leased workers from Apollo Professional
Solutions Inc., Chipton Ross Inc., Chipton Ross Inc.
(Nevada), Collabera Inc., CTS Technical Services Inc.,
Iconma LLC, Moseley Technical Services Inc., PDS
Technical Services, Searchpros Staffing LLC, Triad
Systems International, US Tech Solutions Inc., Volt
Services Inc., and Yoh Services LLC, working on-site at
The Boeing Company, Boeing Commercial Aircraft (BCA),
Portland, Oregon (TA-W-95,914C) who became totally or
partially separated from employment on or after February
28, 2020, through two years from the date of certification,
and all workers in the groups threatened with total or
partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended."
