Amended Certification Regarding Eligibility To Apply for
Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974,
as amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
issued a Certification of Eligibility to Apply for Worker
Adjustment Assistance on March 11, 2020, applicable to workers
and former workers of Siemens Government Technologies, Inc.,
D/B/A/ Dresser Rand, including on-site leased workers from
Walker Services and IT Tech Connexion Systems, Wellsville, New
York (Siemens-Wellsville). Workers of Siemens-Wellsville are
engaged in the production of steam turbines, government and
ventilation units, and related component parts and the supply
of related services

The Department received a request by the State of New
York to amend the certification to include on-site leased
workers from G4S-Buffalo, Pegasus Cleaning Corp., and AVI Food
Systems, Inc.

The Department has determined that these leased workers
were sufficiently under the control of the subject firm to be
considered leased workers.

Based on these findings, the Department is amending this
certification to include workers of G4S-Buffalo, Pegasus
Cleaning Corp., and AVI Food Systems, Inc. on-site at Siemens-
Wellsville. The amended notice applicable to TA-W-95,342 is
hereby issued as follows:

"All workers of Siemens Government Technologies, Inc.,
D/B/A/ Dresser Rand, including on-site leased workers from
Walker Services, IT Tech Connexion Systems, G4S-Buffalo,
Pegasus Cleaning Corp., and AVI Food Systems, Inc.,
Wellsville, New York, who became totally or partially
separated from employment on or after March 3, 2019
through March 11, 2022 and all workers in the group
threatened with total or partial separation from
employment on March 11, 2020 through March 11, 2022, are
eligible to apply for adjustment assistance under Chapter
2 of Title II of the Trade Act of 1974, as amended."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on November 1, 2019 by the State of New York on behalf of
workers and former workers of Siemens Government Technologies,
Inc., D/B/A/ Dresser Rand, including on-site leased workers
from Walker Services and IT Tech Connexion Systems, Wellsville,
New York (Siemens Government Technologies-Wellsville).
Workers whose wages are reported under neither Siemens
Government Technologies, Inc. nor Dresser Rand are excluded from
the worker group. Workers of Siemens Government Technologies-
Wellsville are engaged in activities related to the production
of steam turbines and related components (single-stage and
multiple-stage steam turbines, government and ventilation units)
and the supply of related services. Workers are not separately
identifiable by article produced. The petition states that steam
turbines are produced under both government and commercial
contracts, that single-stage steam turbine production is
shifting to France, that multiple-stage steam turbine production
under commercial contracts ceased in September 2019, and that
the Wellsville, New York facility will close on March 31, 2020.
Workers of Siemens Government Technologies-Wellsville are
eligible to apply for Trade Adjustment Assistance under a
certification issued under TA-W-92,557 (certification expired
on March 2, 2019).
During the course of the investigation, information was
collected from the petition, the workers' firm, and other
sources.
Siemens Government Technologies-Wellsville is scheduled
to permanently close on April 2, 2020. There is no successor-
in-interest firm at the Wellsville, New York location.
Section 222(a) (1) has been met because a significant
number or proportion of the workers in Siemens Government
Technologies-Wellsville have become totally or partially
separated, or are threatened to become totally or partially
separated.
Section 222(a) (2)(A)(i) has been met because the sales
and/or production of steam turbines and related components at
Siemens Government Technologies-Wellsville has declined
absolutely.
Section 222(a)(2)(A)(ii) has been met because imports of
articles like or directly competitive with the steam turbines
and related components produced by Siemens Government
Technologies-Wellsville increased during the relevant period
when compared to the representative base period.
Section 222(a)(2)(A)(iii) has been met because increased
imports contributed importantly to worker group separations
and sales/production declines at Siemens Government
Technologies-Wellsville.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Siemens Government
Technologies-Wellsville, who are engaged in activities related
to the production of steam turbines and related components, meet
the worker group certification criteria under Section 222(a) of
the Act, 19 U.S.C. § 2272(a). In accordance with Section 223 of
the Act, 19 U.S.C. § 2273, I make the following certification:
"All workers of Siemens Government Technologies, Inc.,
doing business as Dresser Rand, including on-site leased
workers from Walker Services and IT Tech Connexion Systems,
Wellsville, New York, who became totally or partially
separated from employment on or after March 3, 2019 through
two years from the date of certification, and all workers
in the group threatened with total or partial separation
from employment on the date of certification through two
years from the date of certification, are eligible to apply
for adjustment assistance under Chapter 2 of Title II of
the Trade Act of 1974, as amended."
