Notice of Termination of Investigation

Pursuant to Section 221 of the Trade Act of 1974, as amended,
an investigation was initiated in response to a petition filed on
May 22, 2019 by a state workforce office on behalf of workers of
EmblemHealth Services Co., LLC Inc., Provider Operations
Department, New York, New York.
The petition regarding the investigation has been deemed
invalid. The petition does not comply with the requirements set
forth in 29 Code of Federal Regulations (C.F.R.) 90.11(c)(2) and
90.11(c)(3). With respect to 29 C.F.R. 90.11(c)(2), the petitioner
did not specify a valid group of workers at EmblemHealth on whose
behalf the petition was filed. With respect to 29 C.F.R.
90.11(c)(3), the investigation revealed that the subject firm,
EmblemHealth, listed in Section 2.b of the petition document did
not employ the subject worker group listed in the petition.
The petition was filed on behalf of separated workers from
EmblemHealth. As the investigation progressed, it was revealed that
the separated worker(s) actually worked for Cognizant during the
period of investigation. A new petition, TA-W-95,509 was filed and
is currently under investigation. Consequently, the investigation
has been terminated.
