Amended Certification Regarding Eligibility to

Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
issued a Certification of Eligibility to Apply for Worker
Adjustment Assistance on March 22, 2019, applicable to workers
of General Motors Lordstown Complex, a wholly owned subsidiary
of General Motors Company, including on-site leased workers
from Development Dimensions International, Warren, Ohio (TA-W-
94,427). The Department's notice of determination was published
in the Federal Register on May 15, 2019 (84 FR 21818-21820).

Subsequently, that certification was amended on December 3,
2019, to include workers of Ryder Integrated Logistics, Inc.,
working on-site at General Motors Lordstown Complex, a wholly
owned subsidiary of General Motors Company, Warren, Ohio (TA-
W-94,427A). The Department's notice of its amended determination
was published in the Federal Register on January 29, 2020 (85 FR
5241-5242).

At the request of a State Workforce Office, the Department
reviewed the amended certification for workers of the subject
firm. The workers were engaged in activities related to the
production of automobiles; specifically, the Chevrolet Cruze.

New information shows that worker separations have occurred
involving employees under the control of the subject firm
working off-site in Kansas City, Kansas. The employees directly
support General Motors Lordstown Complex, Warren, Ohio, by
providing remote IT support services.

The intent of the Department's certification is to include
all workers of the subject firm who were adversely affected by
increased aggregate U.S. imports of articles like or directly
competitive with the articles produced by the workers' firm.

Based on these findings, the Department is amending this
certification to include employees of General Motors Fairfax
Assembly, Applications Operations Services (AOS), a subsidiary
of General Motors LLC, providing IT support services to the
subject firm's Warren, Ohio, facility remotely from Kansas City,
Kansas.

The amended notice applicable to TA-W-94,427B is hereby
issued as follows:

"All workers of General Motors Fairfax Assembly,
Applications Operations Services (AOS), a subsidiary of
General Motors LLC, Kansas City, Kansas (TA-W-94,427B),
who became totally or partially separated from employment
on or after December 21, 2017, through March 22, 2021, and
all workers in the group threatened with total or partial
separation from employment on March 22, 2019 through March
22, 2021, are eligible to apply for adjustment assistance
under Chapter 2 of Title II of the Trade Act of 1974, as
amended."

Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued a
Certification of Eligibility to Apply for Worker Adjustment
Assistance on March 22, 2019, applicable to workers of General
Motors Lordstown Complex, a wholly owned subsidiary of General
Motors Company, including on-site leased workers from Development
Dimensions International, Warren, Ohio (TA-W-94,427). The
Department’s notice of determination was published in the Federal
Register on May 15, 2019 (84 FR 94).
At the request of a state workforce office, the Department
reviewed the certification for workers of the workers’ firm. The
workers were engaged in activities related to the production of
automobiles; specifically, the Chevrolet Cruze (stamping, painting,
assembly, etc.), as described in the affirmative determination.
The state workforce office reported that the workers’ firm
utilized leased workers from Ryder Integrated Logistics, Inc.,
which were excluded from the original certification. The subject
firm verified that these workers were assigned to the General
Motors Lordstown Complex, Warren, Ohio, during the period under
investigation. Accordingly, the Department has determined that
these workers were sufficiently under the operational control of
the subject firm to be considered leased workers.
Note, the workers of Ryder Integrated Logistics, Inc. were not
named within the previous certification of Lordstown under petition
number TA-W-92,410 & TA-W-92,410A
The intent of the Department’s certification is to include all
workers of the subject firm who were adversely affected by
increased aggregate United States imports of articles like or
directly competitive with the articles produced by the workers’
firm. The amended notice applicable to TA-W-94,427, is hereby
issued as follows:
“All workers of General Motors Lordstown Complex, a wholly
owned subsidiary of General Motors Company, including on-
site leased workers from Development Dimensions
International, Warren, Ohio (TA-W-94,427) who became totally
or partially separated from employment on or after March 8,
2019, through March 22, 2021, and all workers in the group
threatened with total or partial separation from employment on
the date of certification through two years from the date of
certification, are eligible to apply for adjustment assistance
under Chapter 2 of Title II of the Trade Act of 1974, as
amended;
AND,
All workers of Ryder Integrated Logistics, Inc., working on-
site at General Motors Lordstown Complex, a wholly owned
subsidiary of General Motors Company, Warren, Ohio (TA-W-
94,427A) who became totally or partially separated from
employment on or after December 21, 2017, through March 22,
2021, and all workers in the group threatened with total or
partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment assistance
under Chapter 2 of Title II of the Trade Act of 1974, as
amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on December 26, 2018 by a state workforce office on
behalf of workers of General Motors Lordstown Complex, a wholly
owned subsidiary of General Motors Company, Warren, Ohio
(herein referred to as "Lordstown Complex"). Lordstown Complex
is also includes on-site leased workers from Development
Dimensions International. The workers' firm is engaged in
activities related to the production of automobiles;
specifically, the Chevrolet Cruze (stamping, painting, assembly,
etc.). Lordstown Complex was previously known as two entities,
Lordstown Stamping and Lordtown Assembly. They have since been
combined into one operation.
The workers of the Lordstown Complex were previously
certified eligible to apply for Trade Adjustment Assistance
under petition numbers under TA-W-92,410 for the stamping
operation and TA-W-92,410A for the assembly operation. The
certification expired on March 7, 2019.
During the course of the investigation, information was
collected from the workers' firm, the petitioner, and other
various sources.
Section 222(a)(1) has been met because a significant
number or proportion of the workers in such workers' firm have
become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(A)(i) has been met because the sales
and/or production of the Chevrolet Cruze by Lordstown Complex
have decreased absolutely.
Section 222(a)(2)(A)(ii) has been met because aggregate
United States imports of articles like or directly competitive
with the article produced by Lordstown Complex have increased.
Finally, Section 222(a)(2)(A)(iii) has been met because
increased aggregate United States imports of articles like or
directly competitive with the article produced by Lordstown
Complex contributed importantly to the worker group
separations and sales/production declines at Lordstown
Complex.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of General Motors
Lordstown Complex, a wholly owned subsidiary of General Motors
Company, including on-site leased workers from Development
Dimensions International, Warren, Ohio, who are engaged in
activities related to the production of automobiles;
specifically the Chevrolet Cruze, meet the worker group
certification criteria under Section 222(a) of the Act, 19
U.S.C. § 2272(a). In accordance with Section 223 of the Act, 19
U.S.C. § 2273, I make the following certification:

"All workers of General Motors Lordstown Complex, a wholly
owned subsidiary of General Motors Company, including on-
site leased workers from Development Dimensions
International, Warren, Ohio, who became totally or
partially separated from employment on or after March 8,
2019 through two years from the date of certification, and
all workers in the group threatened with total or partial
separation from employment on the date of certification
through two years from the date of certification, are
eligible to apply for adjustment assistance under Chapter 2
of Title II of the Trade Act of 1974, as amended."
