At the request of a state workforce office, the Department
reviewed the certification. The company reports that workers leased
from Phoenix Technical Solutions, Inc. and Phoenix Laser Solutions
were employed on-site at the General Electric Company, Erie,
Pennsylvania facility during the relevant period. The Department
has determined that these workers were sufficiently under the
control of the subject firm to be considered leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from Phoenix Technical
Solutions, Inc. and Phoenix Laser Solutions, working on-site at the
Erie, Pennsylvania location of General Electric Company, GE
Transportation Parts, Transportation Division, doing business as
Westinghouse Air Brake Technology Corporation, including workers
whose wages were reported under General Electric International,
Inc., GE Engine Services LLC (TA-W-93,917A).
The amended notice applicable to TA-W-93,917 and TA-W-93,917A
is hereby issued as follows:
"All workers of General Electric Company, GE Transportation
Parts, Transportation Division, doing business as
Westinghouse Air Brake Technology Corporation, including
workers whose wages were reported under General Electric
International, Inc., GE Engine Services LLC, and on-site

all workers of the subject firm who were adversely affected by a
shift in production of locomotives and kits, off-highway
vehicles, and drill motors.

93,917A is hereby issued as follows:

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification
of eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers
in such workers' firm have become totally or partially
separated, or are threatened to become totally or
partially separated;
(2)(B)(i)(I) there has been a shift by the workers'
firm to a foreign country in the production of articles
or supply of services like or directly competitive with
those produced/supplied by the workers' firm; OR
(II) there has been an acquisition from a
foreign country by the workers' firm of
articles/services that are like or directly
competitive with those produced/supplied by
the workers' firm; AND
(ii) the shift/acquisition must have contributed
importantly to the workers' separation or
threat of separation.

The investigation was initiated in response to a petition
filed on June 25, 2018 by a state workforce office on behalf of
workers and former workers of General Electric Company, GE
Transportation Parts, Transportation Division, Erie,
Pennsylvania (GE Transportation). The subject worker group
includes workers whose wages were reported under General
Electric International, Inc., GE Engine Services, LLC and
includes on-site leased workers from Adecco, Adecco Technical,
Adecco USA, Inc., Association of Corporate Counsel America-
Chicago Chapter, Bay Area Techworkers, Capgemini America, Inc.,
Dornerworks, Ltd., Ferguson Enterprises, Inc., Game Seven
Staffing, LLC, GCA Services Group, Inc., HCL America, HCL
Technologies, ITC Infotech, ITC Infotech USA, Inc., MCPC, Inc.,
Newmex LLC, Occupational Health Centers of the Southwest, P.A.,
P.C., Paradigm Infotech, Inc., Parrish Security Services, Inc.,
Quest Global Engineering Private Ltd., Quest Global Services Na,
Inc., Riverside Technical Services, Securitas Security Services
USA, Inc., Tata Consultancy Services Limited, Watson & Barron,
Ltd., Wolseley Industrial Group, and Yoh/Managed Staffing.
Workers of GE Transportation are engaged in activities related to
the production of locomotives and kits, off-highway vehicles, and
drill motors.
An earlier certification included workers of Adecco and
Yoh/Managed Staffing but did not include the leasing/staffing
agencies covered by TA-W-93,917A.
During the course of the investigation, information was
collected from the workers' firm and the petition.
Section 222(a)(1) has been met because a significant number
or proportion of the workers in GE Transportation have become
totally or partially separated, or are threatened to become
totally or partially separated.
Section 222(a)(2)(B) has been met because the workers' firm
has shifted to a foreign country a portion of the production of
the article(s) like or directly competitive with the article(s)
produced by the subject workers which contributed importantly to
workers separations (total or partial, actual or threat) at GE
Transportation.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of GE Transportation, who
are engaged in activities related to the production of locomotives
and kits, off-highway vehicles, and drill motors, meet the worker
group certification criteria under Section 222(a) of the Act, 19
U.S.C. § 2272(a). In accordance with Section 223 of the Act, 19
U.S.C. § 2273, I make the following certifications:
"All workers of General Electric Company, GE Transportation
Parts, Transportation Division, including workers whose
wages were reported under GE Engine Services, GE
Transportation Parts LLC, and including on-site leased
workers from Adecco and Yoh/Managed Staffing, Erie,
Pennsylvania (TA-W-93,917), who became totally or partially
separated from employment on or after June 24, 2018, through
two years from the date of certification, and all workers in
the group threatened with total or partial separation from
employment on the date of certification through two years
from the date of certification, are eligible to apply for
adjustment assistance under Chapter 2 of Title II of the
Trade Act of 1974, as amended"; AND
"All workers of Association of Corporate Counsel America
Chicago Chapter, Bay Area Techworkers, Capgemini America,
Inc., Dornerworks, Ltd., Ferguson Enterprises, Inc., Game
Seven Staffing, LLC, GCA Services Group, Inc., HCL America,
HCL Technologies, ITC Infotech, ITC Infotech USA, Inc., MCPC,
Inc., Newmex LLC, Occupational Health Centers of the
Southwest, P.A., P.C., Paradigm Infotech, Inc., Parrish
Security Services, Inc., Quest Global Engineering Private
Ltd., Quest Global Services NA, Inc., Riverside Technical
Services, Inc., Securitas Security Services USA, Inc., Tata
Consultancy Services Limited, Watson and Barron, Ltd., and
Wolseley Industrial Group, working on-site at General
Electric Company, GE Transportation Parts, Transportation
Division, Erie, Pennsylvania (TA-W-93,917A), who became
totally or partially separated from employment on or after
June 22, 2017, through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended."
