Amended Certification Regarding Eligibility

To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance on September 26, 2019, applicable to workers of
Harley-Davidson Motor Company Operations, Inc., Kansas City
Vehicle and Powertrain Operations, including workers whose wages
were reported under Harley-Davidson Motor Company Group, LLC, and
including on-site leased workers from Aerotek; Artech Information
Systems LLC; Atterro Inc. DBA Pro Staff; Bear Staffing Service
Inc.; Capital Talent Partners; Collabera Inc.; Enterforce Inc.;
Express Services, Inc. (KC); HRU, Inc.- Technical Resources;
ICONMA LLC; Insight Global; Mid States Technical (MST), Mindlance
Inc.; Murtech-Hdds; Peer Technical Group; PMC Recruiting; QPS
Employment Group, Inc.; Yoh Staffing; GDI Integrated Facility

Services; Syncreon US, Inc.; and Kelly Services, Inc., Kansas
City, Missouri. The workers are engaged in activities related to
the production of motorcycles and related parts. The Department's
Notice of determination was published in the Federal Register on
April 22, 2020 (85 FR 22458).

At the request of a state workforce office, the Department
reviewed the certification for workers of the subject firm. The
state workforce office's report that the workers' firm utilized
leased workers from Henkel Corporation at the Kansas City,
Missouri facility was confirmed. Accordingly, the Department has
determined that these workers were sufficiently under the control
of the subject firm to be considered leased workers.

Based on these findings, the Department is amending this
certification to include workers leased from Henkel Corporation
working on-site at the Kansas City, Missouri location of Harley-
Davidson Motor Company Operations, Inc., Kansas City Vehicle and
Powertrain Operations.

The amended notice applicable to TA-W-93,882 is hereby
issued as follows:

"All workers of Harley-Davidson Motor Company Operations,
Inc., Kansas City Vehicle and Powertrain Operations, including
workers whose wages were reported under Harley-Davidson Motor
Company Group, LLC, and including on-site leased workers from
Aerotek; Artech Information Systems LLC; Atterro Inc. DBA Pro

Staff; Bear Staffing Service Inc.; Capital Talent Partners;
Collabera Inc.; Enterforce Inc.; Express Services, Inc. (KC);
HRU, Inc.- Technical Resources; ICONMA LLC; Insight Global; Mid
States Technical (MST), Mindlance Inc.; Murtech-Hdds; Peer
Technical Group; PMC Recruiting; QPS Employment Group, Inc.; Yoh
Staffing; GDI Integrated Facility Services; Syncreon US, Inc.;

At the request of a state workforce office, the Department
reviewed the certification for workers of the subject firm. The
workers were engaged in activities related to the production of
motorcycles and related parts, as described in the affirmative
determination.
The state workforce office reported that the workers’ firm
utilized leased workers from GDI Integrated Facility Services,
Syncreon US, Inc., and Kelly Services, Inc., which were excluded
from the original certification. The subject firm verified that
these workers were assigned to Harley-Davidson Motor Company
Operations, Inc., Kansas City Vehicle and Powertrain Operations,
Kansas City, Missouri, during the period under investigation.
Accordingly, the Department has determined that these workers were
sufficiently under the operational control of the firm to be
considered leased workers.
The intent of the Department’s certification is to include all
workers of the subject firm who were adversely affected by
increased aggregate United States imports of articles like or
directly competitive with the articles produced by the workers’
firm.
The amended notice applicable to TA-W-93,882, is hereby issued
as follows:
“All workers of Harley-Davidson Motor Company Operations,
Inc., Kansas City Vehicle and Powertrain Operations,
including workers whose wages were reported under Harley-
Davidson Motor Company Group, LLC, and including on-site
leased workers from Aerotek; Artech Information Systems LLC;
Atterro Inc. DBA Pro Staff; Bear Staffing Service Inc.;
Capital Talent Partners; Collabera Inc.; Enterforce Inc.;

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and
(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and
(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on June 12, 2018 by a state workforce office on behalf of
workers of Harley-Davidson Motor Company Operations, Inc.,
Kansas City Vehicle and Powertrain Operations, including
workers whose wages were reported under Harley-Davidson Motor
Company Group, LLC, and including on-site leased workers from
Aerotek; Artech Information Systems LLC; Atterro Inc. DBA Pro
Staff; Bear Staffing Service Inc.; Capital Talent Partners;
Collabera Inc.; Enterforce Inc.; Express Services, Inc. (KC);
HRU, Inc.- Technical Resources; ICONMA LLC; Insight Global; Mid
States Technical (MST), Mindlance Inc.; Murtech-Hdds; Peer
Technical Group; PMC Recruiting; QPR Employment Group, Inc.; and
Yoh Staffing, Kansas City, Missouri (herein known as "Harley-
Davidson"). The workers' firm is engaged in activities related
to the production of motorcycles and related parts. Workers are
not separately identifiable by product.
Section 222(a)(1) has been met because a significant
number or proportion of the workers in such workers' firm have
become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(A)(i) has been met because the sales
and/or production of motorcycles by Harley-Davidson have
decreased absolutely.
Section 222(a)(2)(A)(ii) has been met because aggregate
United States imports of articles like or directly competitive
with the article produced by Harley-Davidson have increased.
Finally, Section 222(a)(2)(A)(iii) has been met because
increased aggregate United States imports of articles like or
directly competitive with the article produced by the Harley-
Davidson contributed importantly to the worker group
separations and sales/production declines at Harley-Davidson.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Harley-Davidson Motor
Company Operations, Inc., Kansas City Vehicle and Powertrain
Operations, including workers whose wages were reported under
Harley-Davidson Motor Company Group, LLC, and including on-
site leased workers from Aerotek; Artech Information Systems
LLC; Atterro Inc. DBA Pro Staff; Bear Staffing Service Inc.;
Capital Talent Partners; Collabera Inc.; Enterforce Inc.;
Express Services, Inc. (KC); HRU, Inc.- Technical Resources;
ICONMA LLC; Insight Global; Mid States Technical (MST),
Mindlance Inc.; Murtech-Hdds; Peer Technical Group; PMC
Recruiting; QPR Employment Group, Inc.; and Yoh Staffing, Kansas
City, Missouri, who are engaged in activities related to the
production of motorcycles and related parts, meet the worker
group certification criteria under Section 222(a) of the Act, 19
U.S.C. § 2272(a). In accordance with Section 223 of the Act, 19
U.S.C. § 2273, I make the following certification:
"All workers of Harley-Davidson Motor Company Operations,
Inc., Kansas City Vehicle and Powertrain Operations,
including workers whose wages were reported under Harley-
Davidson Motor Company Group, LLC, and including on-site
leased workers from Aerotek; Artech Information Systems
