Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
issued a Certification of Eligibility to Apply for Worker
Adjustment Assistance on December 14, 2017, applicable to
workers of Triumph Aerostructures, Triumph Aerospace Structure
Division, a subsidiary of Triumph Group, Red Oak, Texas. The
Department’s notice of determination was published in the
Federal Register (83 FR 8893) on March 1, 2018. The Department
of Labor issued an Amended Certification Regarding Eligibility
to Apply for Worker Adjustment Assistance on June 13, 2018,
applicable to the workers of Triumph Aerostructures, Triumph
Aerospace Structure Division, a subsidiary of Triumph Group, Red
Oak, Texas. The subject workers are engaged in activities
related to supplying aerospace structures and components.
At the request of the state workforce office to address the
issue of on-site leased workers, the Department reviewed the
certification and the amended certification applicable to
workers of the subject firm. New information from the company
shows that workers leased from Aerostructures Contract
Employees, Johnson Service Group, and Chipton Ross were working
on-site at Triumph Aerostructures, Triumph Aerospace Structure
Division, a subsidiary of Triumph Group, Red Oak, Texas. The
Department has determined that these workers were sufficiently
under the control of Triumph Aerostructures, Triumph Aerospace
Structure Division, a subsidiary of Triumph Group, Red Oak,
Texas, to be considered leased workers.
The intent of the Department’s certification is to include
all workers of the workers’ firm who were adversely affected
based upon being a Supplier and losing business with a firm
whose workers were certified eligible to apply for Trade
Adjustment Assistance.
Based on these findings, the Department is amending this
certification to include workers leased from Aerostructures
Contract Employees, Johnson Service Group, and Chipton Ross,
working on-site at Triumph Aerostructures, Triumph Aerospace
Structure Division, a subsidiary of Triumph Group, Red Oak,
Texas.
The amended notice applicable to TA-W-92,882 is hereby
issued as follows:
"All workers of Triumph Aerostructures, Triumph
Aerospace Structure Division, a subsidiary of Triumph
Group, including on-site leased workers from
Aerostructures Contract Employees, Johnson Services
Group, and Chipton Ross, Red Oak, Texas, who became
totally or partially separated from employment on or
after March 13, 2017 through December 14, 2019, and
all workers in the group threatened with total or
partial separation from employment on date of
certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade
Act of 1974, as amended.”

Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
issued a Certification of Eligibility to Apply for Worker
Adjustment Assistance on December 14, 2017, applicable to
workers of Triumph Aerostructures, Triumph Aerospace Structure
division, a subsidiary of Triumph Group, Red Oak, Texas. The
Department’s notice of determination was published in the
Federal Register (83 FR 8893) on March 1, 2018.
At the request of a state workforce office, the Department
reviewed the certification for workers of the subject firm. New
information revealed that on March 12, 2015, a certification of
eligibility to apply for adjustment assistance was issued for
all workers of Triumph Aerostructures, Vought Aircraft Division,
including on-site leased workers from Aerostructures Contract
Employees, Inc., Chipton-Ross, Inc., Johnson Service Group,
Inc., Multax Systems, Inc., and Volt Management Corporation, Red
Oak, Texas, separated from employment on or after December 12,
2013 through March 12, 2017. The notice was published in the
Federal Register (80 FR 19694) on April 13, 2015. It was
confirmed by the petitioner that the worker group the basis of
the certification under petitions number TA-W-85,722 and TA-W-
92,882 are the same.
In order to avoid an overlap in worker group coverage, the
Department is amending May 10, 2016 impact date established for
TA-W-92,882 and substituting it for March 13, 2017.
The amended notice applicable to TA-W-92,822 is hereby
issued as follows:
“All workers of Triumph Aerostructures, Triumph Aerospace
Structure division, a subsidiary of Triumph Group, Red
Oak, Texas, who became totally or partially separated from
employment on or after March 13, 2017 through December 14,
2019, and all workers in the group threatened with total or
partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification
of eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a firm
under Section 222(b) of the Act, 19 U.S.C. § 2272(b), can be
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in the
workers' firm or an appropriate subdivision of the firm
have become totally or partially separated, or are
threatened to become totally or partially separated;
(2) the workers' firm is a Supplier or Downstream Producer
to a firm that employed a group of workers who received
a certification of eligibility under Section 222(a) of
the Act, 19 U.S.C. § 2272(a), and such supply or
production is related to the article or service that was
the basis for such certification; and
(3) either
(A) the workers' firm is a supplier and the component
parts it supplied to the firm described in paragraph (2)
accounted for at least 20 percent of the production or
sales of the workers' firm;
or
(B) a loss of business by the workers' firm with the
firm described in paragraph (2) contributed importantly
to the workers' separation or threat of separation.

The investigation was initiated in response to a petition
filed on May 11, 2017 by the United Aerospace Workers (UAW), Local
848 on behalf of workers of Triumph Aerostructures, Triumph
Aerospace Structure Division, a subsidiary of Triumph Group, Red
Oak, Texas (Triumph Aerostructures). The workers' firm is engaged
in activities related to the supply of aerospace structures and
components. Workers are separately identifiable by articles
produced by the firm.
The worker group does not include on-site leased workers.
Section 222(b)(1) has been met because a significant number
or proportion of the workers in such workers' firm have become
totally or partially separated, or are threatened to become
totally or partially separated.
Section 222(b)(2) has been met because workers of Triumph
Aerostructures is a Supplier to a firm that employed a group of
workers who received a certification of eligibility under Section
222(a) of the Act, 19 U.S.C. § 2272(a), and such supply is related
to the actual finished article or service that was the basis for
such certification.
Section 222(b)(3)(B) has been met because the loss of
business by Triumph Aerostructures with the aforementioned firm
contributed importantly to worker separations at Triumph
Aerostructures, Red Oak, Texas.

Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Triumph Aerostructures
meet the worker group certification criteria under Section 222(b)
of the Act, 19 U.S.C. § 2272(b). In accordance with Section 223 of
the Act, 19 U.S.C. § 2273, I make the following certification:
"Workers of Triumph Aerostructures, Triumph Aerospace
Structure Division, a subsidiary of Triumph Group, Red Oak,
Texas, who became totally or partially separated from
employment on or after May 10, 2016 through two years from
the date of certification, and all workers in the group
threatened with total or partial separation from employment
on the date of certification through two years from the date
of certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended."
