Notice of Revised Determination
on Reconsideration

On April 13, 2018, the Department issued a Notice of
Termination of Investigation applicable to workers and former
workers of Symantec Corporation, Springfield, Oregon (subject firm)
on the basis that the petitioning workers are eligible to apply for
Trade Adjustment Assistance under TA-W-90,075 (certification
expired on December 4, 2017). The Department’s Notice will soon be
published in the Federal Register. Workers at the subject firm are
engaged in employment related to the supply of information
management services.
On May 8, 2018, the State of Oregon and Symantec Corporation
jointly requested administrative reconsideration, asserting that
the Department’s Notice of Termination of Investigation was based
in a mistake in fact.
During reconsideration investigation, Symantec Corporation
officials provided supplemental information that supports the
Department’s finding that a shift of operations to a foreign
country(s) contributed importantly to worker group separations at
Symantec Corporation, Springfield, Oregon which occurred after
December 4, 2017.
Conclusion
After careful review of previously-submitted and additional
material, I determine that workers and former workers of Symantec
Corporation, Springfield, Oregon, who are engaged in employment
related to the supply of information management services, meet the
worker group certification criteria under Section 222(a) of the
Act, 19 U.S.C. § 2272(a). In accordance with Section 223 of the
Act, 19 U.S.C. § 2273, I make the following certification:
"All workers of Symantec Corporation, Springfield, Oregon, who
became totally or partially separated from employment on or
after December 5, 2017, through May 15, 2020, and all workers
in the group threatened with total or partial separation from
employment on May 15, 2018 through May 15, 2020, are eligible
to apply for adjustment assistance under Chapter 2 of Title II
of the Trade Act of 1974, as amended.”

Notice of Termination of Investigation

Pursuant to Section 221 of the Trade Act of 1974, as amended,
an investigation was initiated in response to a petition filed on
May 2, 2017 by the State of Oregon on behalf of workers of Symantec
Corporation, Human Resources Division, including workers whose
wages were reported through Veritas Software Corporation,
Springfield, Oregon. The petition requested that the
certification of TA-W-90,075 be amended to include workers within
the Human Resources Division.
The worker group on whose behalf the petition was filed is
included in the amended certification of TA-W-90,075.
Consequently, the investigation has been terminated.
