Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
issued an Amended Certification of Eligibility to Apply for
Worker Adjustment Assistance on May 22, 2018, applicable to
workers of Axeon Specialty Products LLC, including workers
reporting wages under Axeon Refining LLC, Paulsboro, New Jersey
(TA-W-92,754), Axeon Refining LLC, a wholly-owned subsidiary of
Axeon Specialty Products LLC, San Antonio, Texas (TA-W-92,754A),
and Axeon Refining LLC, a wholly-owned subsidiary of Axeon
Specialty Products LLC, Stamford, Connecticut (TA-W-92,754B).
At the request of the state workforce office, the
Department reviewed the certification for workers of the subject
firm. The workers were engaged in activities related to the
production of asphalt and related products.
New information shows that Axeon Refining LLC was purchased
by Associated Asphalt Partners (AAP). Accordingly, the
Department is amending this certification to clarify that it
includes workers reporting wages under Associated Asphalt
Partners (AAP).
The amended notice applicable to TA-W-92,754, TA-W-92,754A,
and TA-W-92,754B is hereby issued as follows:

"All workers of Axeon Specialty Products LLC, including
workers reporting wages under Axeon Refining LLC, including
workers reporting wages under Associated Asphalt Partners
(AAP), Paulsboro, New Jersey (TA-W-92,754), Axeon Refining
LLC, a wholly owned subsidiary of Axeon Specialty Products
LLC, including workers reporting wages under Associated
Asphalt Partners (AAP), San Antonio, Texas (TA-W-92,754A),
and Axeon Refining LLC, a wholly owned subsidiary of Axeon
Specialty Products LLC, including workers reporting wages
under Associated Asphalt Partners (AAP), Stamford,
Connecticut (TA-W-92,754B), who became totally or partially
separated from employment on or after March 24, 2016,
through January 23, 2020, and all workers in the group
threatened with total or partial separation from employment
on date of certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended.”

Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued a
Certification of Eligibility to Apply for Worker Adjustment
Assistance on January 23, 2018, applicable to workers of Axeon
Specialty Products LLC, including workers reporting wages under
Axeon Refining LLC, Paulsboro, New Jersey. The Department’s notice
of determination was published in the Federal Register on March 1,
2018 (83 FR 8891).
At the request of a state workforce office, the Department
reviewed the certification for workers of the subject firm. The
workers' firm is engaged in activities related to the production of
asphalt and related products.
New information was collected that revealed that the
separations at Axeon Specialty Products LLC, Paulsboro, New Jersey
location also affected the subject’s firm workers located in San
Antonio, Texas and Stamford, Connecticut.
The intent of the certification is to include all workers who
were adversely affected by increased imports of asphalt and/or
related products.
The amended notice applicable to TA-W-92,754 is hereby issued
as follows:

“All workers of Axeon Specialty Products LLC, including
workers reporting wages under Axeon Refining LLC,
Paulsboro, New Jersey (TA-W-92,754), Axeon Refining LLC,
a wholly-owned subsidiary of Axeon Specialty Products
LLC, San Antonio, Texas (TA-W-92,754A), Axeon Refining
LLC, a wholly-owned subsidiary of Axeon Specialty
Products LLC, Stamford, Connecticut (TA-W-92,754B) who
became totally or partially separated from employment on
or after March 24, 2016, through January 23, 2020, and
all workers in the group threatened with total or partial
separation from employment on date of certification
through two years from the date of certification, are
eligible to apply for adjustment assistance under Chapter
2 of Title II of the Trade Act of 1974, as amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on March 24, 2017 by the United Steelworkers, Local
District 4, on behalf of workers of Axeon Specialty Products
LLC, including workers reporting wages under Axeon Refining
LLC, Paulsboro, New Jersey (Axeon). The workers' firm is
engaged in activities related to the production of asphalt and
related products. Workers are not separately identifiable by
article produced.
During the course of the investigation, information was
collected from the workers' firm.
Section 222(a)(1) has been met because a significant
number or proportion of the workers in such workers' firm have
become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(A)(i) has been met because the sales
and/or production at Axeon have decreased absolutely.
Section 222(a)(2)(A)(ii) has been met because imports of
articles like or directly competitive with the article
produced by Axeon have increased during the relevant period
when compared to the representative base period.
Finally, Section 222(a)(2)(A)(iii) has been met because
increased imports of like or directly competitive articles
contributed importantly to the worker group separations and
sales/production declines at Axeon.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Axeon, Paulsboro, New
Jersey, who are engaged in activities related to the production
of asphalt and related products, meet the worker group
certification criteria under Section 222(a) of the Act, 19
U.S.C. § 2272(a). In accordance with Section 223 of the Act, 19
U.S.C. § 2273, I make the following certification:
"All workers of Axeon Specialty Products LLC, including
workers reporting wages under Axeon Refining LLC,
Paulsboro, New Jersey, who became totally or partially
separated from employment on or after March 24, 2016
through two years from the date of certification, and all
workers in the group threatened with total or partial
separation from employment on the date of certification
through two years from the date of certification, are
eligible to apply for adjustment assistance under Chapter 2
of Title II of the Trade Act of 1974, as amended."
