And Negative Determination Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or
are threatened to become totally or partially separated; and
(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and
(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and
(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on November 21, 2016 by the State Workforce Office on
behalf of workers of Intel Corporation, Ocotillo Campus,
Chandler, Arizona (TA-W-92,433; hereafter referred to as
"Intel-Ocotillo Campus") and Intel Corporation, Chandler
Campus, Chandler, Arizona (TA-W-92,433A; hereafter referred to
as "Intel-Chandler Campus"). The workers' firm is engaged in
activities related to the production of wafer level integrated
circuits. Workers are not separately identifiable by the article
produced.
The worker group at Intel-Ocotillo Campus (TA-W-92,433)
includes on-site leased workers from Acculogic Inc., Advantest
America Inc., Air Liquide Electronics US LP, Air Products &
Chemicals Inc., Applied Materials Inc., ASM America Inc., ASML
US Inc., Astronics Test Systems Inc., AT&T, Atlas Copco
Compressors LLC, Axcelis Technologies Inc., Besi North America
Inc., Black Box Network Services, Bon Appetit Management
Company, Brooks Automation Inc., Bruker AXS Inc., Cadence
Design Systems Inc., Cymer Inc., Daifuku Co. LTD, DCG Eaton
Corp., Delta Design Inc., Disco Hi Tec America Inc., Eaton

The worker group at Intel-Chandler Campus (TA-W-92,433A)
does not include any on-site leased workers.
During the course of the investigation, information was
collected from the workers' firm.

The investigation revealed that workers of Intel
Corporation, Ocotillo Campus, Chandler, Arizona, meet the
criteria for certification.
Section 222(a)(1) has been met because a significant
number or proportion of the workers in Intel-Ocotillo Campus
have become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(A)(i) has been met because sales and/or
production at Intel-Ocotillo Campus have decreased absolutely.
Section 222(a)(2)(A)(ii) has been met because imports of
articles like or directly competitive with those produced by
Intel-Ocotillo Campus have increased during the relevant
period when compared to the representative base period.
Section 222(a)(2)(A)(iii) has been met because increased
imports contributed importantly to worker group separations
and sales/production declines at Intel-Ocotillo Campus.

The investigation revealed that workers of Intel
Corporation, Chandler Campus, Chandler, Arizona, do not meet
the criteria for certification.
With respect to Section 222(a) of the Act, the
investigation revealed that Criterion (2) has not been met
because sales and/or production at Intel-Chandler Campus have
not decreased absolutely.
With respect to Section 222(b)(2) of the Act, the
investigation revealed that Intel-Chandler Campus is not a
Supplier nor a Downstream Producer to a firm that employed a
group of workers who received a certification of eligibility
under Section 222(a) of the Act, 19 U.S.C. § 2272(a).
In addition, the group eligibility requirements under
Section 222(e) of the Act have not been satisfied because Intel-
Chandler Campus has not been publicly identified by name by the
International Trade Commission as a member of a domestic
industry in an investigation resulting in an affirmative finding
of serious injury, market disruption, or material injury, or
threat thereof.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that, with regards to the worker
group covered by TA-W-92,433A, the requirements of Section 222
of the Act, 19 U.S.C. § 2272, have not been met and, therefore,
deny the petition for group eligibility of Intel Corporation,
Chandler Campus, Chandler, Arizona, to apply for adjustment
assistance, in accordance with Section 223 of the Act, 19 U.S.C.
§ 2273.
After careful review of the facts obtained in the
investigation, I determine that that workers of Intel
Corporation, Ocotillo Campus, Chandler, Arizona, who are
engaged in activities related to the production of wafer level
integrated circuits, meet the worker group certification
criteria under Section 222(a) of the Act, 19 U.S.C. § 2272(a),
in accordance with Section 223 of the Act, 19 U.S.C. § 2273.
In accordance with Section 223 of the Act, 19 U.S.C. § 2273, I
make the following certification:
"All workers of Intel Corporation, Ocotillo Campus,
including on-site leased workers from Acculogic Inc.,
Advantest America Inc., Air Liquide Electronics US LP,
Air Products & Chemicals Inc., Applied Materials Inc.,
ASM America Inc., ASML US Inc., Astronics Test Systems
Inc., AT&T, Atlas Copco Compressors LLC, Axcelis
Technologies Inc., Besi North America Inc., Black Box
Network Services, Bon Appetit Management Company, Brooks
Automation Inc., Bruker AXS Inc., Cadence Design Systems

certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended."
