Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance on November 22, 2016, applicable to workers and former
workers of Weyerhaeuser NR Company, Wood Products Division, a
subsidiary of Weyerhaeuser Company, including on-site leased
workers from LC Staffing Services and workers whose unemployment
insurance (UI) wages are reported under another FEIN number,
Columbia Falls, Montana. The workers’ firm is engaged in
activities related to the production of lumber and plywood
products.
At the request of State Workforce Office, the Department
reviewed the certification for workers of the subject firm.
The Department has determined that the subject worker group
includes all workers at/reporting to facilities located at 500
12th Avenue West, Columbia, Falls, Montana (TA-W-92,137), 526 1st
Avenue West, Columbia Falls, Montana (TA-W-92,137A), and 2050
Highway 2 West, Kalispell, Montana (TA-W-92,137B), including but
not limited to workers at the lumber mill and the plywood mill;
includes all workers engaged in production and/or the support of
production at 500 12th Avenue West, Columbia, Falls, Montana (TA-
W-92,137), 526 1st Avenue West, Columbia Falls, Montana (TA-W-
92,137A), and 2050 Highway 2 West, Kalispell, Montana (TA-W-
92,137B), including but not limited to workers who provide
administrative services, forestry services, and information
technology services; and includes all remote/teleworkers reporting
to facilities located at 500 12th Avenue West, Columbia, Falls,
Montana (TA-W-92,137), 526 1st Avenue West, Columbia Falls,
Montana (TA-W-92,137A), and 2050 Highway 2 West, Kalispell,
Montana (TA-W-92,137B).
The subject worker group also includes all workers who
operate out of/report to ancillary offices (including but not
limited to outposts, trailers, and forest stations) which operate
in conjunction with the facilities located at 500 12th Avenue West,
Columbia, Falls, Montana, 526 1st Avenue West, Columbia Falls,
Montana, and 2050 Highway 2 West, Kalispell, Montana.
In addition, the subject worker group includes leased workers
of LC Staffing Services on-site at 500 12th Avenue West, Columbia,
Falls, Montana, 526 1st Avenue West, Columbia Falls, Montana, 2050
Highway 2 West, Kalispell, Montana, as well as workers at any of
the afore-identified facilities/ancillary offices whose wages
are/were reported under another FEIN, including but not limited to
one associated with Plum Creek.
Accordingly, the Department is amending this certification to
properly reflect this matter. The amended notice applicable to TA-
W-92,137 is hereby issued as follows:
“All workers of Weyerhaeuser NR Company, Wood Products
Division, a subsidiary of Weyerhaeuser Company, including
on-site leased workers from LC Staffing Services and workers
whose unemployment insurance (UI) wages are reported under
another FEIN number, 500 12th Avenue West, Columbia Falls,
Montana (TA-W-92,137), Weyerhaeuser NR Company, Wood
Products Division, a subsidiary of Weyerhaeuser Company,
including on-site leased workers from LC Staffing Services
and workers whose unemployment insurance (UI) wages are
reported under another FEIN number, 526 1st Avenue West,
Columbia Falls, Montana (TA-W-92,137A), and Weyerhaeuser NR
Company, Flathead Resource Unit, a subsidiary of
Weyerhaeuser Company, including on-site leased workers from
LC Staffing Services and workers whose unemployment
insurance (UI) wages are reported under another FEIN
number, 2050 Highway 2 West, Kalispell, Montana (TA-W-
92,137B), who became totally or partially separated from
employment on or after August 23 2015, through November 22,
2018, and all workers in the group threatened with total or
partial separation from employment on November 22, 2016
through November 22, 2018, are eligible to apply for
adjustment assistance under Chapter 2 of Title II of the
Trade Act of 1974, as amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification
of eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or are
threatened to become totally or partially separated; and
(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and
(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and
(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or threat
of separation and to the decline in the sales or production
of such firm.

The investigation was initiated in response to a petition
filed on August 24, 2016 by a state workforce office on behalf of
workers of Weyerhaeuser NR Company, Wood Products Division, a
subsidiary of Weyerhaeuser Company, including on-site leased
workers from LC Staffing Services and workers whose unemployment
insurance (UI) wages are reported under another FEIN number,
Columbia Falls, Montana (Weyerhaeuser-Wood Products). The
workers' firm is engaged in activities related to the production
of lumber and plywood products.
During the course of the investigation, information was
collected from the workers' firm, the U.S. International Trade
Commission, and the U.S. Department of Commerce.
Section 222(a)(1) has been met because a significant number
or proportion of the workers in Weyerhaeuser-Wood Products have
become totally or partially separated, or are threatened to become
totally or partially separated.
Section 222(a)(2)(A)(i) has been met because the sales
and/or production of lumber and plywood products at Weyerhaeuser-
Wood Products have decreased absolutely. Section
222(a)(2)(A)(ii) has been met because imports of articles like
or directly competitive with the lumber and plywood produced by
Weyerhaeuser-Wood Products have increased during the relevant
period when compared to the representative base period. Section
222(a)(2)(A)(iii) has been met because increased imports
contributed importantly to worker group separations and
sales/production declines at Weyerhaeuser-Wood Products.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Weyerhaeuser-Wood
Products, meet the worker group certification criteria under
Section 222(a) of the Act, 19 U.S.C. § 2272(a). In accordance
with Section 223 of the Act, 19 U.S.C. § 2273, I make the
following certification:
"All workers of Weyerhaeuser NR Company, Wood Products
Division, a subsidiary of Weyerhaeuser Company, including
on-site leased workers from LC Staffing Services and workers
whose unemployment insurance (UI) wages are reported under
another FEIN number, Columbia Falls, Montana, who became
totally or partially separated from employment on or after
August 23 2015, through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended."
