In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
issued a Certification of Eligibility to Apply for Worker
Adjustment Assistance on March 28, 2017, applicable to workers

Information submitted during the course of a pending
investigation shows that the workers of the Sales and Marketing
Group are part of the worker group in TA-W-92,078.
The intent of the Department’s certification is to include
all workers of the subject firm who were adversely affected by
the increased imports of wafers. Based on these findings, the
Department is amending this certification to include the workers
of the Sales and Marketing Group. Further, the worker group
includes workers of the afore-identified units in Rio Ranch, New
Mexico located at, but not limited to, the following addresses:
1600 Rio Rancho Blvd. S.E. Rio Rancho, New Mexico, 87124; and
1600 Sara Road Rio Ranch, New Mexico, 87124. The amended notice
applicable to TA-W-92,078 is hereby issued as follows:
"All workers of Intel Corporation, Sales and
Marketing Group, Data Center Group, Intel Security
Group, Internet of Things Group, Non-Volatile Memory

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on August 2, 2016 by the state workforce office on behalf
of workers of Intel Corporation, Data Center Group, Intel
Security Group, Internet of Things Group, Non-Volatile Memory
Solutions Group, Platform Engineering Group, Software and
Services Group, Technology and Manufacturing Group, Rio
Rancho, New Mexico (hereafter referred to as "Intel-Rio
Rancho"). The workers' firm is engaged in activities related to
the production of wafers.
The subject worker group includes on-site leased workers
from 3M Company, Advantest America Inc., Air Products &
Chemicals Inc., Applied Materials Inc., ASM America Inc.,
AT&T, Black Box Network Services, Bruker Nano, Cadence Design
Systems Inc., CH2M Hill Engineers Inc., Clair Company Inc.,
Clean Harbors Environmental Services Inc., Compsych Corp.,
Currie & Brown Inc., Cymer Inc., Daifuku Co. LTD, DHL Global
Forwarding, Edwards Vacuum Inc., EMC Corp., Enterprise

Workers are not separately identifiable by the article
produced.
The subject worker group excludes workers of the IT
Division. Workers of the IT Division are eligible to apply
for worker adjustment assistance under an existing
certification (TA-W-86,018; Intel Corporation, IT Division,
Rio Rancho, New Mexico) which expires March 7, 2018).
During the course of the investigation, information was
collected from the workers' firm.
Section 222(a)(1) has been met because a significant
number or proportion of the workers in Intel-Rio Rancho have
become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(A)(i) has been met because the sales
and/or production of wafers by Intel-Rio Rancho have decreased
absolutely.
Section 222(a)(2)(A)(ii) has been met because company
imports of articles like or directly competitive with the
articles produced by Intel-Rio Rancho have increased during
the relevant period when compared to the representative base
period.
Section 222(a)(2)(A)(iii) has been met because increased
imports contributed importantly to the worker group
separations and sales/production declines at Intel-Rio Rancho.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Intel Corporation,
Data Center Group, Intel Security Group, Internet of Things
Group, Non-Volatile Memory Solutions Group, Platform
Engineering Group, Software and Services Group, Technology and
Manufacturing Group, Rio Rancho, New Mexico, who are engaged in
activities related to the production of wafers meet the worker
group certification criteria under Section 222(a) of the Act, 19
U.S.C. § 2272(a). In accordance with Section 223 of the Act, 19
U.S.C. § 2273, I make the following certification:

"All workers of Intel Corporation, Data Center Group,
Intel Security Group, Internet of Things Group, Non-
Volatile Memory Solutions Group, Platform Engineering
Group, Software and Services Group, Technology and
Manufacturing Group, including on-site leased workers from
3M Company, Advantest America Inc., Air Products &
