Notice of Termination of Investigation

Pursuant to Section 221 of the Trade Act of 1974, as amended,
an investigation was initiated in response to a petition filed on
September 1, 2015 by three workers on behalf of Runnells
Specialized Hospital, Berkeley Heights, New Jersey
The petition regarding the investigation has been deemed
invalid. The worker group was not employed by a firm, but a
government entity. 29 CFR 90.11 states that a petition may be
filed by "...a group of workers..." 29 CFR 90.2 defines group as
"three or more workers in a firm..." 29 CFR 90.2 defines a firm as
"...an individual proprietorship, partnership, joint venture,
association, corporation (including a development corporation),
business trust, cooperative, trustee in bankruptcy, and receiver
under decree of any court." Public agencies are not eligible to
file a petition to apply for worker group eligibility to apply for
Trade Adjustment Assistance. Consequently, the investigation has
been terminated.
