In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
issued a Certification of Eligibility to Apply for Worker
Adjustment Assistance on August 6, 2015, applicable to workers
of The Boeing Company, Boeing Commercial Aircraft, (BCA),
including on-site leased workers from Adecco USA, Inc.,
Chipton Ross, Inc., Cascade Engineering, CDI Corporation,
Comforce Corporation, CTS Technical Services, Inc., Computer
Staffing Services, D3 Technologies, Dassault System Services,
Foker Elmo Inc., Fujitsu America, Inc., Kaman Engineering
Services, Inc., Kaman Global Aerosystems, Inc., Midcom,
Moseley Technical Services, Inc., PDS Technical Services,
Triad Systems International, TASS Inc., Volt Services, Inc.,
and YOH Services, Inc., working in multiple cities throughout
Washington State (TA-W-86,001), and leased workers from 22nd
Century Technologies, Inc., 24 Seven, Inc., American
Cybersystems, Inc., APA Services, Apex Systems Inc., Apollo

The workers are engaged in activities related to the production
of commercial aircraft and supporting services. The
Department’s Notice of determination was published in the
Federal Register on September 22, 2015 (80 FR 183).
At the request of the state workforce office, the
Department reviewed the certification of TA-W-86,001 and TA-W-
86,001A.
New information from the company shows that workers leased
from Tata Consultancy Services were employed on-site at The
Boeing Company, Boeing Commercial Aircraft (BCA) working in
multiple cities throughout Washington State and are part of
the worker group covered by TA-W-86,001A. The intent of the
Department’s certification is to include all workers of The
Boeing Company, Boeing Commercial Aircraft (BCA) working in
multiple cities throughout Washington State who were adversely
affected by increased aggregate imports of commercial aircraft
and supporting services.
Based on these findings, the Department is amending the
certification of TA-W-86,001A to include workers leased from
Tata Consultancy Services working on-site at various The Boeing
Company, Boeing Commercial Aircraft (BCA) facilities in multiple
cities throughout Washington State. The amended notice
applicable to TA-W-86,001 is hereby issued as follows:
"All leased workers from 22nd Century Technologies,
Inc., 24 Seven, Inc., American Cybersystems, Inc.,
APA Services, Apex Systems Inc., Apollo Professional
Solutions Inc., Aquent LLC, Artech Information
Systems LLC, Ateeca Inc., Chipton Ross Inc.,
(Nevada), Collabera Inc., Columbus Technologies and
Services Inc., Computer Task Group Inc., CTS
International Inc., Geologics Corporation,
Globalpundits Inc., Iconma LLC, Maxim Healthcare
Services, Inc., Planetechs LLC, Rose International,
Inc., Searchpros Solutions, Special Counsel, Strom
Aviation, Inc., STS Aerostaff Services, TAD PGS,

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on May 11, 2015 by International Association of Machinists
& Aerospace Workers (IAMAW), District Lodge, 751 on behalf of
workers of The Boeing Company, Boeing Commercial Aircraft,
(BCA), including on-site leased workers from Adecco USA, Inc.,
Chipton Ross, Inc., Cascade Engineering, CDI Corporation,
Comforce Corporation, CTS Technical Services, Inc., Computer
Staffing Services, D3 Technologies, Dassault System Services,
Foker Elmo Inc., Fujitsu America, Inc., Kaman Engineering
Services, Inc., Kaman Global Aerosystems, Inc., Midcom,
Moseley Technical Services, Inc., PDS Technical Services,
Triad Systems International, TASS Inc., Volt Services, Inc.,
YOH Services, Inc., 22nd Century Technologies, Inc., 24 Seven,
Inc., American Cybersystems, Inc., APA Services, Apex Systems

is the subject of this investigation.
The workers' firm is a multinational aerospace and defense
corporation headquartered in Chicago, Illinois. The subject
worker group is engaged in activities related to the production
of commercial aircraft and support staff.
The filing union provided the following allegation in the
petition document, "The Boeing Company has continued the
strategy of outsourcing instituted in 2012. The Company has
outsourced manufacturing support to Australia, Canada, Mexico,
Russia, and India.
This has resulted in loss of employment of their Everett,
Seattle, Renton facilities and others (i.e. Puget Sound).
Additionally, Boeing competes for sales domestically with
foreign companies such as Airbus and Bombardier"
Workers of The Boeing Company, Boeing Commercial Aircraft,
(BCA), in the following cities; Auburn, Everett, Puyallup,
Renton, Seattle, Tukwila and Mukilteo were previously
certified eligible to apply for Trade Adjustment Assistance on
June 12, 2013, under (TA-W-85,705-TA-W-85,705F). TA-W-85,705-TA-
W-85,705F, was based on an Acquisition of Articles from a
Foreign Country, that certification expired on June 12, 2015.
Workers of Adecco USA, Inc., Chipton Ross, Inc., Cascade
Engineering, CDI Corporation, Comforce Corporation, CTS
Technical Services, Inc., Computer Staffing Services, D3
Technologies, Dassault System Services, Foker Elmo Inc.,
Fujitsu America, Inc., Kaman Engineering Services, Inc., Kaman
Global Aerosystems, Inc., Midcom, Moseley Technical Services,
Inc., PDS Technical Services, Triad Systems International,
TASS Inc., Volt Services, Inc., and YOH Services, Inc., were
included in that certification.
During the course of the investigation, information was
collected from the workers' firm, the petitioning unions, GAMA
an international trade association of general aviation airplanes
and rotorcraft, engines, avionics, components and related
services and various news articles.
Section 222(a)(1) has been met because a significant
number or proportion of the workers in such workers' firm have
become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(A)(i) has been met because the sales
and/or production of commercial aircraft by Boeing Commercial
Aircraft, have decreased absolutely.
Section 222(a)(2)(A)(ii) has been met because aggregate
imports of production like or directly competitive with the
article produced by The Boeing Company, Boeing Commercial
Aircraft (BCA), by have increased. In the period under
investigation, May 8, 2014 when compared to May 8, 2015, The
Boeing Company, Boeing Commercial Aircraft (BCA), lost U.S.
market share to their sole competitor Airbus Group N.V.
Finally, Section 222(a)(2)(A)(iii) has been met because
increased aggregate imports contributed importantly to the
worker group separations and sales/production declines at
Boeing Commercial Aircraft.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of The Boeing Company,
Boeing Commercial Aircraft, (BCA), including on-site leased
workers from Adecco USA, Inc., Chipton Ross, Inc., Cascade
Engineering, CDI Corporation, Comforce Corporation, CTS
Technical Services, Inc., Computer Staffing Services, D3
Technologies, Dassault System Services, Foker Elmo Inc.,
Fujitsu America, Inc., Kaman Engineering Services, Inc., Kaman
Global Aerosystems, Inc., Midcom, Moseley Technical Services,
Inc., PDS Technical Services, Triad Systems International,
TASS Inc., Volt Services, Inc., YOH Services, Inc., 22nd
Century Technologies, Inc., 24 Seven, Inc., American
Cybersystems, Inc., APA Services, Apex Systems Inc., Apollo
Professional Solutions Inc., Aquent LLC, Artech Information
