Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
issued a Certification of Eligibility to Apply for Worker
Adjustment Assistance on October 8, 2015, applicable to workers
and former workers of the subject firm. Workers are engaged in
activities related to the production of steel tubular goods.
The Department is amending the certification to clarify
that workers and former workers of IPSCO Koppel Tubulars, Inc.,
including on-site leased workers from Integrative Staffing,
Koppel, Pennsylvania, are eligible to apply for Trade Adjustment
Assistance. The amended notice applicable to TA-W-85,939 is
hereby issued as follows:



"All workers of IPSCO Koppel Tubulars, Inc., including on-
site leased workers from Integrative Staffing, Koppel,
Pennsylvania, who became totally or partially separated
from employment on or after April 7, 2014 through October
8, 2017, and all workers in the group threatened with total
or partial separation from employment on October 8, 2015
through October 8, 2017, are eligible to apply for
adjustment assistance under Chapter 2 of Title II of the
Trade Act of 1974, as amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), can be
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(II)(aa) imports of articles like or directly
competitive with articles into which one or more
component parts produced by such firm are directly
incorporated have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.


The investigation was initiated in response to a petition
filed on April 14, 2015 on behalf of workers of IPSCO Tubulars
(OK) Inc., a subsidiary of IPSCO Tubulars, Inc., Catoosa,
Oklahoma (TA-W-85,939), IPSCO Koppel Tubulars, LLC, a
subsidiary of IPSCO Tubulars, Inc., Ambridge, Pennsylvania
(TA-W-85,939A), IPSCO Tubulars (KY) Inc., a subsidiary of
IPSCO Tubulars, Inc., Wilder, Kentucky (TA-W-85,939B), IPSCO
Tubulars, Inc. d/b/a TMK-IPSCO, Houston, Texas (TA-W-85,939C),
TMK-IPSCO, a subsidiary of IPSCO Tubulars, Inc., Camanche,
Iowa (TA-W-85,939D), and TMK-IPSCO, a subsidiary of IPSCO
Tubulars, Inc., Blytheville, Arkansas (TA-W-85,939E)
(hereafter collectively referred to as “IPSCO”). The workers’
firm is engaged in activities related to the production of
tubular goods such as seamless and welded, line pipe, mechanical
tubing, coupling stock and treading, ASTM pipe, API casting,
semi-premium and premium threading. The worker groups are not
separately identifiable by articles produced by the firm.
The subject worker groups include on-site leased
leased/temporary workers from Integrative Staffing, CM Personnel
Services Inc., Randstad Professionals, RGP, Robert Half
Management Resources, Employer Flexible, Kelly Services Inc.,
Adecco Engineering & Technical, DYSIS, Temp Plus Staffing, and
Sedona Staffing Services; however, the afore-mentioned leased
workers are not on-site at all of the IPSCO locations.
During the course of the investigation, information was
collected from the workers’ firm.
Section 222(a)(1) has been met because a significant
number or proportion of the workers at each of the afore-
mentioned locations of the workers’ firm have become totally or
partially separated, or are threatened to become totally or
partially separated.
Section 222(a)(2)(A)(i) has been met because the sales
and/or production of tubular goods by IPSCO have decreased
absolutely.
Section 222(a)(2)(A)(ii) has been met because subject
firm imports of articles like or directly competitive with the
articles produced by IPSCO have increased during the relevant
period.
Finally, Section 222(a)(2)(A)(iii) has been met because
increased imports contributed importantly to the worker groups
separations and sales/production declines at IPSCO.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of IPSCO Tubulars (OK)
Inc., Catoosa, Oklahoma, IPSCO Koppel Tubulars, LLC, Ambridge,
Pennsylvania, IPSCO Tubulars (KY) Inc., Wilder, Kentucky,
IPSCO Tubulars, Inc., Houston, Texas, TMK-IPSCO, Camanche,
Iowa, and TMK-IPSCO, Blytheville, Arkansas, who are engaged in
activities related to the production of tubular goods, meet the
worker group certification criteria under Section 222(a) of the
Act, 19 U.S.C. § 2272(a). In accordance with Section 223 of the
Act, 19 U.S.C. § 2273, I make the following certification:
“All workers of IPSCO Tubulars (OK) Inc., a subsidiary of
IPSCO Tubulars Inc., Catoosa, Oklahoma (TA-W-85,939),
IPSCO Koppel Tubulars, LLC, a subsidiary of IPSCO
Tubulars, Inc., including on-site leased workers from
Integrative Staffing, Ambridge, Pennsylvania (TA-W-
85,939A), IPSCO Tubulars (KY) Inc., a subsidiary of IPSCO
Tubulars, Inc., including on-site leased workers from CM
Personnel Services, Inc., Randstad Professionals, RPG,
and Robert Half Management Resources, Wilder, Kentucky
(TA-W-85,939B), IPSCO Tubulars, Inc., d/b/a TMK-IPSCO,
including on-site leased workers from Employer Flexible,
Kelly Services, Inc., Adecco Engineering & Technical, and
DYSIS, Houston, Texas (TA-W-85,939C), TMK-IPSCO, a
subsidiary of IPSCO Tubulars, Inc., including on-site
leased workers from Sedona Staffing Services, Camanche,
Iowa (TA-W-85,939D), and TMK-IPSCO, a subsidiary of IPSCO
Tubulars, Inc., including on-site leased workers from
Temps Plus Staffing, Blytheville, Arkansas (TA-W-85,939E),
who became totally or partially separated from employment
on or after April 7, 2014, through two years from the date
of certification, and all workers in the group threatened
with total or partial separation from employment on the
date of certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended.”
